leave shall not extend beyond six (6) months from the date of commencement. An employee shall <br />be entitled to use vacation leave or sick leave in lieu of being unpaid. If an employee exhausts a(I <br />vacation leave credit and sick leave credits, the smployee' shall not be paid for parental leave. <br />During any unpaid portion of such leave, the employee shall not accumulate sick leave credits for <br />that period. Empioyees seeking parentai leave must notify the Employer thres (3) days prior to <br />taking leave. <br />Section 5. General Leave Provisions: <br />(a) All leaves of absences when known in advance (and any extensions thereof) <br />must be applied for and granted in writing on forms provided by the City (copy to <br />the employee). The employee and the Union wiii be notified within three (3) <br />working days from the date the appiication was made for approvai or denial of the <br />requested leave. (b) An employee shall accumulate seniority during any leave of absence, but he <br />shall nat be entitled to any benefits, except that the City shall continue to pay its <br />portion of the employee's hospitalizabon insurance in Article 19 for a three (3) <br />month period. After the three (3) month period, an empioyee must direct pay any <br />required hospitailsurgical premiums to the City on or before the monthly due <br />date. <br />(c) When an empioyee retums to work after a leave of absence, he wiii be assigned <br />to the position which he formeriy occupied at the then current rate of pay, or to a <br />similar position if his foRner position no longer exists, if he is physically qualified <br />for the job. In the event, the City questions whether the employee is physicaliy <br />able to do the wor{c, the City wii( require the employee #o fumish a City supplied <br />medical certifiicate of a physician supporting his ciaim of fitness, and the City <br />shall have the right to have the emp(oyee examined by a doctor of its choice. If <br />disagreement thereafter exists, a third physician shall be mutually selected by <br />the Union and the City to determine the issue, and the opinion of the third <br />physician shall be final on the parties. The charges made by the thircf physician <br />shall be shared equally by the City and the Union. <br />If it is found that a leave of absence is not actually being used for the purpose for which <br />it was granted, the City shall cancel the leave and it may impose disciplinary action up to and <br />inciuding discharge. <br />ems:opeiu/1794af1-cio _20_ <br />
