<br />ARTICLE 12 - LAY OFFS <br />Section 1. W henever it is necessary for the City to reduce its forces, the employees <br />within the department to be reduced, will be laid aff in the following order. <br />(a) Students; <br />(b) Part-time and seasanal employees; <br />(c) Employees who have not completed their probationary period; <br />(d) Reguiar fuA-time employees within the classification affected who have completed <br />their probationary period; <br />(e) In the application of the foregoing, employees wiii be retained by reason of their <br />seniority only if they are abie to perfarm <br />the avai(able worlc. <br />(fi) For the purpose of this Articie, students participating in school or other subsidized <br />: related work programs or employees <br />working part-time under county or othersubsidized programs shall not be inciuded <br />in the definition of students under <br />subsection (a) or part-time employees under subsection (b) of this Article. <br />Section 2. Regularfuii-time employees shall be laid off on the basis of theirseniority within <br />their ciassification. When the seniority or service of two or more employees is equal, employees <br />shail be laid off by the drawing af lots. In the event an employee cannot hold his present <br />classification, he shall have the right to "bump" an employee with lesser seniority in an equal or <br />Iower rate classification within the City, provided the employee has the ability ta do the work of the <br />classification. <br />Section 3. Whenever practicable, regular fu(i-time employees shall be given a minimum <br />at two (2) weeks advance notice of layoff for lack of work. <br />ems:opeiul1784af1-cio -21- <br />x.
