Whenever the City anticipates that a position within a ciassification that is covered by this <br />collective bargaining agreement is currently occupied wiil become open within thirty (30) working <br />days as a result of a retirement, termination, resignation or as a result of another job posting and <br />the City determines that the position wiil be retained or fiited, it may be permitted to post the <br />position and classification for a period of seven (7) consecutive working days and award the <br />position. <br />Section 2. AI( timely applications wiii be reviewed by the City and the job shall be awarded <br />within five (5) working days to the most senior applicant who possess the skill and ability to <br />perform the job, except those employees moving to a(ower rated ciassification or moving lateraUy <br />shall be awarded the job in preference to employees seeking a promotion. lf no employee who <br />appliss has the necessary skill or ability, the City shall have the authority ta hire autside the <br />bargaining unit. If the City chooses to test an employee, the objective portion of testing a <br />employee's ski!l and ability to operate equipment, shall be given in a fair and equitable manner <br />and will be given on equipment that is required to be used in the job classification. Effective June <br />1, 1995 through the duration of this agreement, regular full-time Clerical and Technical Unit <br />personnel may bid on jobs in the Service / Waste Water Unit, providing no eligible employee within <br />that unit has bid on the job. Job postings for Service / Waste Water unit positions will be posted <br />at the bul(etin board iocations cited in Article 5. Employees awarded such jobs will be given an <br />opportunity to qualify pursuant ta Article 14, Section 3. !f no employee in either bargaining unit has <br />the skill, experience and abiiity for the job, the City may hire from outside the bargaining units. <br />Section 3. An employee awarded a job under Section 2 above will be given reasonable <br />help and supervision and shall be allowed thirty (30) working days to qualify for the position.
