An employee shail become eligible for vacation leave on his anniversary date and vacation leave sna!l be taken by the employee within tweive (12) months thereafter. However, so long as an employee uses at least five (5) uninterrupted days of vacation each year, the employee shail be permitted with prior approval to carry over or to sefl back any amount of vacation which does not exceed the amount eamed in the prior year. Section 3, lf an employee is terminated (voluntarily or involuntarily) prior to taking his vacation and has compfeted one (1) year of employment with the Ciiy, he shali receive the prorated portion of any accrued but unused vacation at the time of separation. In case of death of an employee, the unused vacation leave shall be paid to the estate. (a) if a day recognized as a holiday by the terms of this Agreement fails within an employes's vacation leave, the employee shafl not be credited with a vacation day, and wi(I be paid for the haliday at the straight time rate. (b) An employee may have the option of using personal days as days o# ex#ended vacation with prior approvai of his department head. (c) An employee may have the option of using aA but one weeK of his vacation in increments of less than ane week; for example, one or fin?a days at a time. An . employee will give the supervisor at least forty-eight (48) hours' advance notice in writing. In an emergency situation verbal communication with the supervisor is appropria#e and may justify waiving advance notification. Section 4. Regular fulf-time employees hired after July 1, 1995 shall be granted vacation at a rate of pay equal to that of their current base rate of pay.
