The investigating officer <br />of the complaint may be the complainant. <br />SECTION 10: In mposing discipline on a current charqe, the <br />C?.ty wil]. not basei progressive discipline on prior discipl3.nary <br />action which is more than three (3) years old, exeept for prior <br />discipiinary action involving cases of violence or theft. <br />ARTZCZ.E s : <br />ASSOCIATION REPRESENTATION <br />SECTI4N I: The parties recognize that it may be necessary for <br />an employee representative of the OPBA to leave a normal work <br />assignment while acting in the capacity of rep=esentative. The <br />OPSA recognizes the operational needs of the E,mployer and wi11 <br />cooperate to keep to a minimum the ti.me lost from work by <br />representatives. Before leaving an assignment pursuant to this <br />section, the representative must abtain agproval from the officer <br />in charge of the shift.
