0 4. . <br />BEREAVEMENT LEAVE <br />ARTICLE XXIV <br />Section 1. All employees shall be granted bereavement leave <br />(not to be deducted from the employee's accumulated sick leave) <br />according to the following schedule, to wit: <br />(a) Upon the death of an immediate family member, other <br />than spouse, three (3) days; and <br />(b) Upon the death of a spouse, or a child of the immediate <br />family, five (5) days. <br />Section 2. For the purposes of this Article, immediate <br />family shall mean: parents; parents of spouse; brother; sister; <br />brother of spouse; sister of spouse; grandparent; grandchild; as <br />well as persons living in the employee's home. <br />INJURY LEAVE <br />ARTICLE XXV <br />Section 1. In the event that a full-time employee of the <br />North Olmsted Police Department should be injured while in the <br />line of duty due to a sudden and accidental occurrence, and such <br />injury has so incapacitated said member of the Police Department <br />than he is temporarily unable to work, then the Director of <br />Public Safety, after determining that said injury is work-related <br />and is of a temporary nature, may authorize ninety (90) days sick <br />leave. If after such ninety (90) day sick leave period said <br />employee is still temporarily incapacitated, then the Director of <br />Public Safety shall recommend to Council whether or not to <br />continue said salary. Council shall forthwith review the matter <br />and, by majority vote, determine whether the employee shall <br />continue to receive his fu11 salary during recuperation. <br />For the purpose of this paragraph, a sudden and acci- <br />dental injury shall include such incidents as an automobile <br />accident, assault, gun shot wound and the like. It may not be <br />considered as sudden and accidental if an injury or incapacita- <br />tion results from lifting, slipping, tripping or falling. <br />Section 2. Any full-time employee of the Police Department <br />who qualifies for benefits under this Article srall be required <br />to pay over to the City any amount received from the Bureau of <br />Workers Compensation as supplemental waqes. Further, if at any <br />time the City determines, on the basis of inedical evidence, that <br />employee is permanently disabled and will no lonqer be able to <br />carry on his duties, then the City may terminate payments and <br />insist that employee go on a pension program. <br />-18-
