{ L <br />? <br />laterals, the installation and maintenance of sanitary sewer connections, the <br />control of infiltration and inflow and ttie pretreatment of industrial wastes, <br />as those requirements, rules and regulations are amended and modified from <br />time to time, or (ii) requirements, rules and regulations that are more re- <br />strictive than those so maintained bq North Olmsted from time to time. The <br />requirements, rules and regulations maintained by North Olmsted at the time of <br />execution of this Agreement are set forth in the Codified Ordinances of North <br />Oimsted under (i) Chapter 911, "Sewers Generally", a copy of which, together <br />with a copy of Ordinance No. 88-17 and Ordinance No. 88-89 each amending <br />Sections 911.09 and 411.10, is attached hereto as Exhibit C, (ii) Chapter 917, <br />"Industrial Pretreatment", a copy of which is attached hereto as Exhibit D and <br />(iii) Chapter 919, "Roadside Ditches", a copy of which is attached hereto as <br />Exhibit E. Upon any amendment, modification or enactment of additional <br />requirements, rules and regulations, North Olmsted shall promptly provide to <br />Fairview Park copies of such amendment, modification or addition. <br />1.05 Inspection and Additional Capacity. The North Olmsted Engineer <br />shall have the right to inspect the portion of the North Olmsted Sanitary <br />Sewer System serving the Service Area and the points of entry from the Service <br />Area to the North Olmsted Sanitary Sewer System from time to time. The cost <br />of such inspections shall be an expense of operation, maintenance and replace- <br />ment of the Joint Use Facilities for the purposes of Section 4.00. <br />The North Olmsted Engineer may determine, on the basis of appropriate <br />evidence and documentativn, that the flow from the Service Area exceeds the <br />peak instantaneous flow rate or the dailq flow limit under subsection 1.01 and <br />so notify the Fairview Park Engineer. Thereafter, Fairview Park shall not <br />issue permits for anq additional connections to any tributary sewers located <br />- 6 -
