i <br />• . . ? ? <br />in the Service Area and (in the case of an excess in the peak instantaneous <br />flow rate) North Olmsted shall not issue permits for any additional connec- <br />tions Lo any sewers tributary to the Joint Coilection Facilities. Upon <br />notification of the North Olmsted Engineer's-determination, North Olmsted and <br />Fairview Park shall imtnediately commence negotiations to provide the addi- <br />tional capacity required or to reduce the flow from the Service Area and shall <br />amend or supplement this Agreement for that purpose. <br />1.06 Improvements to North Olmsted Sanitary Sewer System. In the <br />event that North Olmsted shall determine it to be necessary in order to serve <br />the Service Area to enlarge, expand or otherwise improve any portion of the <br />North Olmsted Sanitary Sewer System used jointly by North Olmsted and Fairview <br />Park in serving the Service Area or to construct additional sewers for such <br />joint use or to enlarge, expand or otherwise improve North Olmsted's waste- <br />water treatment plant, or, in the further event that any governmental author- <br />ity having jurisdiction in the premises shall notify North Olmsted that any <br />such improvement is required, the cost of any such improvement shall be shared <br />by North Olmsted and Fairview Park upon such terms and conditions as are <br />mutually agreed upon and incorporated in an amendment or supplement to this <br />Agreement. <br />2.00 Fairview Park Procedure. <br />2.01 Connections. No connection to the sewers in the Service Area <br />shall be made until after the issuance of a permit for that purpose by the <br />Fairview Park Engineer. No permit shall be issued for a connection to any <br />sewer in the Service Area if Fairview Park has been notified that the flow <br />from the Service Area exceeds the peak instantaneous flow rate or the daily <br />fiow limit under subsection 1.01 or that anq governmental authority having <br />- 7 -
