Page 23 <br />i_ <br />-' be appealed to the Mayor or his designee and his decision <br />shall be final. <br />ARTICLE XXX <br />COMPENSATORY TIME <br />30.1 Each EmployeP shall have the right to convert Overtime <br />hours into Compensatory Time with the approval of the <br />Fire Chief or his designee. <br />30.2 Employees may have the right to take Compensatory Time <br />when the time off does not interfere with_the operation_ <br />of the Fire Department. The-taking off of such <br />Compensatory Time shall be subject to the approval of-the <br />Fire Chief or his designee. Overtime shall be converted <br />to Compensatory Time at the current rate of pay plus <br />Longevity equal to one and one-half hours per hour <br />converted. <br />30.3 In case of death of an Employee, any payment shall be <br />made to the Employee's legal beneficiaries. <br />ARTICLE XXXI <br />IMPASSE PROCEDURE <br />31.1 The procedures contained in this section shall govern <br />the settlement of disputes between the Employer and the <br />Association concerning the modification of the existing <br />collective bargaining agreement or negotiations of a <br />successor agreement. <br />31.2 In the case of either party requesting modification of <br />the current agreement, the party requesting modification <br />shall: <br />A. Serve written notice upon the other party of the <br />proposed modification. The Party must serve notice <br />not less than sixty days prior to the time it is <br />_ proposed__to modify. <br />B. Offer to bargain collectively with the other party <br />for the purpose of modifying the existing Agreement. <br />C. Notify the State Employment Relations Board of the <br />offer by serving upon the board a copy of the written <br />notice to the other party and a copy of the existing <br />collective bargaining agreement. <br />D. Upon receipt of the notice, the parries shall enter <br />into collective bargaining. - --- - <br />E. In the event the parties are unable to reach an <br />agreement, the impasse procedure as set forth in <br />Section 4117.14C(2) O.R.C. shall prevail. <br />31.3 In the case of negotiating a successor collective bargaining
