Any sample which has been adulterated or is shown to be a <br />substance other than urine sha71 be reported as such. All samples <br />which test positive on a screening test shall be confirmed by gas <br />chromatography-mass spectrophotometry, and no records of <br />unconfirmed positive tests shall be released or retained by the <br />laboratory. <br />Testino shall be conducted in a manner to ensure that an <br />Fnployee's legal drug use aoes not effect the test results. <br />All results shall be evaluated by a suitable trained occugational <br />physician or cccupational nurse prior to being reported. <br />Test results shall be treated with the same coniidentiality as <br />other Fmployee niedical records. The test results shall not be <br />reported outside the Fire Department. <br />33.5 UNDM THE INFLLTEidCE OF ALCOHOL <br />For the purposes of detern.inind when a North Olmsted Fire Fighter <br />is under the influence of alcohol, the City of North Olnsted will <br />follow the guidelines set forth by the Ohio Revised Code, Section <br />4511.19. The relevant portion of the Code states that a person is <br />considered lmder the influence of alcohol when this person has a <br />concentration of ten-hundredths (0.10) or more by weight of <br />alcohol in his blood. If a Fise Fibhter is tested and found to <br />hace 0.10 alcohol in his blood, he/she will be subject.to the <br />disciplinary action as stated in the collective bargaining <br />abreement. <br />33.7 QiEN1ICAL DrPE?1i DEDTCY PROGRAM <br />Ea.ch person whose urine tests positive for illicit drugs shall <br />be nedically evaluated, counseled and treated for rehabilitation, <br />if required. In addition, at any ticne an Fmployee may voluntarily <br />enter the chenical dependency program without fear of disciplinary <br />actions against him. Zhis program is designated to provide ca.re <br />and treatrient to Fmployees who are in need of rehabilitation. <br />Details concerning treatment any ?ployee receives at this program <br />shall remain confidential and shall not be released to the public. <br />The Fire Departnent shall provide the cost of treatment. <br />No Fiaployee shall be relieved or transferred to other than his <br />usual duties on the ba.sis of one test result although the Fmployee <br />may be re-evaluated for his duty assignment. When undergoing <br />treatment and evaluation employees shall receive the usual <br />conpensation and fringe benefits provided at their assio ed <br />position. <br />33.8 RIGIU OF APPEAL <br />Each Employee has the right to challenge the results of drud <br />?.. testing in the same manner that he r,iay grieve any managerial <br />action. <br />? <br />-29- <br />. .. ,. - -
