In no event shall the employee be permitted to <br />accumulate vacation leave credit in excess of the vacation <br />leave credit earned in the prior year. Employees shall be <br />required to take, or request to be paid, for such accumulated <br />vacation leave credit within one (i) year from the date the <br />employee requested accumulation of such vacation leave <br />credit. An employee shall forfeit his right to take or be <br />paid for any vacation leave to his credit which is in excess <br />of the accumulated vacation credit for one (i) prior year. <br />All such excess vacation leave credit shall be eliminated <br />from the employee's vacation leave balance. . <br />section 3: All vacation time shall be paid at the regular <br />wage rate, except when the employee requests vacation credit <br />accumulation. For the purpose of calculating vacation pay, <br />when vacation accumulation is requested by an employee, the <br />wage rate at the time the vacation was requested to be <br />accumulated shall be used to calculate vacation pay. If, due <br />to scheduling, vacations cannot be taken subsequent to the <br />year such vacation was earned and are accumulated and taken <br />in the next subsequent year, the rate of vacation pay shall <br />be at the rate of pay during the year such vacation is taken, <br />provided the same is approved by the Department Head. <br />Section 4: Vacations must be scheduled with and authorized <br />by the Chief of Police or his designee. Schedules are to be <br />coordinated so as not to disrupt necessary City services or <br />functions of the department. <br />Section 5:. If an employee is terminated (voluntarily or <br />involuntarily) prior to taking his vacation and has completed <br />one (1) year of employment with the City, he shall receive <br />the prorated portion of any accrued but unused vacation at <br />the time of separation. In case of death of an employee, the <br />unused vacation leave shall be paid to the estate. <br />17 <br />, <br />_....?„._ . . _
