Section 15.02. Any non-probationary employee who is disciplined shall <br />be able to appeal such disciplinary action only through the Grievance <br />Procedure herein contained. <br />Section 15.03. An employee may review his personnel file upon <br />reasonable notice. The Fmployer and the employee may have a representative <br />present when this review occurs. <br />Section 15.04. tidritten reprimands and records of verbal reprimands <br />other than accidents; that are more than twenty-four (24) months old shall <br />not be used against the employee, provided there has been no subsequent <br />disciplinary action during said period. <br />Section 15.05. An enployee shall be informed of any complaints ma.de <br />about his performance and shall be given the opportunity to meet with the <br />Operations Supervisor or Maintenance Supervisor, depending on classification, <br />to discuss said complaints. The employee shall have the right to have a <br />representative of the NOTEA present when such complaints are discussed. <br />Section 15.06. An employee shall be notified when garnishment orders <br />are received by the Enployer. Such notification shall be gi.ven as soon as <br />reasonably possible. <br />Section 15.07. Discipline shall be applied as per Conditions of <br />Fmployment and Rules and Regulations Manual that came into effect June 17, <br />1990. (i.e. Green Book) - <br />Section 15.08. Progressive discipline for chargeable accidents, within <br />an eighteen (18) month period, shall be applied as follows: <br />First Chargeable Warning Letter <br />Second Chargeable One (1) to Five (5) Day suspension <br />with possible retraining. <br />Thi.rd Chargeable Thirty (30) Day suspension or <br />discharge. <br />Fourth Chargeable Discharge. <br />Management reserves the right to waive the above disciplinarX action <br />called for, based an the degree of seriousness of the accident, upon <br />investigation. <br />Section 15.09. The Enployer shall provide to the NOTEA a copy of a11 <br />written disciplinary actions against members of bargainin,g unit. The NOTEA <br />will provide listing of a11 current members to the General Manager. <br />ARTICLE XVI <br />GRIEVANCE PROCIDURE <br />Section 16.01. Every non-probationa.ry full-time employee and the NOTEA <br />shall have the right to present a grievance in accordance with the procedures <br />provided herein, free fran any interference, coercion, restraint, <br />discrimination or reprisal. A NOTEA representative shall have the right to <br />be present at all stages of the Grievance Procedure. It is the intent and <br />purpose of the parties to this Agreement that all grievances shall be <br />settled, if possible, at the lowest step of this procedure. <br />-7-
