Section 14.03. Where because of economy, consolidation or otherwise, <br />the employer determines it necessary to reduce the size of its work force, <br />such reduction shall not be made without notifying the NOTEA. <br />Section 14.04. The least senior employee with the Transit Department, <br />by classification, shall be first laid off, provided sufficient remaining <br />employees have the skill and ability to perform the remaining work. Should a <br />position in the Transit Department ance consolidated be found necessary to be <br />re-created or re-established within two (2) years frcn1 the date of <br />consolidation, or should a vacancy occur through death, resignation or other <br />cause within two (2) years from the date of consolidation of the position or <br />layoff, the most senior laid-off employee sha.ll be entitled to the position, <br />by classification, provided that on his separation date he had the skill and <br />ability for the position. If an employee laid off as prescribed in this <br />section enters into the active service of the U. S. Armed Forces, such period <br />of service shall not be counted in the two (2) year recall period. <br />Section 14.05. When a vacancy occurs, the vacancy shall be filled by <br />the employees on the recall list in the order in which the employees are <br />ranked on the list, in their classification, provided the employee has the <br />skill and ability to perform the job in question. An elnployee shall be <br />offered a vacancy by the Fmployer sending a certified letter, return receipt <br />requested, through the U. S. Mail to the enployee's last lazown address with a <br />copy to the NOTEA president. It is the employee's responsibility to inform <br />the Enployer of his correct address. If the employee wishes to accept the <br />vacancy, he must inform the General Manager's office, or his designated <br />representative within ane week of receipt of the certified letter. If the <br />employee does not respond within the set period, his name shall be removed <br />from the recall list. <br />Section 14.06. Part-time employment shall not be permitted within the <br />same job classificatian while there is any full-time employee on the active <br />recall list within that job classification <br />Sectian 14.07. During the period a full-time employee is on lay off, he <br />ma.y continue his health plan coverage, at his own expense, provided during <br />active employment with the bnployer, and any improvements made in that health <br />plan coverage. , <br />Section 14.08. Zhe Fmployer shall continue to provide NOTEA with a <br />current recall list. <br />ARTICLE XV <br />DISCIPLINE <br />Section 15.01. A non-probationary employee who is disciplined shall be <br />given a written notice of such discipline stating the reason(s) thereof, <br />within five (5) days from the date of such action. the NOTEA shall have the <br />right to have a representative at every step of the disciplinary process. <br />-6-
