?- <br /> <br />AGREEMENT TO P R SF RF A T PR (1 ERTY <br />This Agreement, entered into at North Olmsted, Ohio this day of , 1996 <br />by and between the City of North Olmsted (hereinafter, the "Seller"), and Dominic J. and Angela <br />Pishnery (hereinafter the "Purchaser") <br />WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain <br />portion of the real property located at 27473 Mill Road, North Olmsted, Ohio, Permanent Parcel <br />#232-9-34 and #232-9-35, which shall become part of the right-of-way in connection with the <br />proposed widening of Mill Road. <br />NOW THEREFORE, on the basis of the foregoing premise, for the consideration <br />hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: <br />MM ONE• Purchace and Saip of Real PropeM <br />Subject to the terms and conditions of this Agreement, the Seller agrees to sell and the <br />Purchaser agrees to purchase all of the Seller's right, title and interest in the above-mentioned part <br />of the real property, which is located at 27473 Mill Road, North Olmsted, Ohio. The real <br />property being sold is a ten foot (10') wide strip of land fronting on Mill Road, and legally <br />described in attached Exhibit "A". In addition, Sellers agree that they shall fully cooperate with <br />the City and do all acts necessary in the splitting off of said ten foot (10') strip from their property <br />at 27473 Mill Road, including, but not limited to, signing the necessary subdivision plat or plats. <br />ITEM TWO: Grant of Right of Fntry Construction Fasement <br />Subject also to the terms and conditions of this Agreement, Seller further agrees to grant <br />Purchaser a Right of Entry-Construction Easement in substantially the form as the attached <br />EXHIBIT "C"
