22. <br />ad3oins the°a~de line of the lot, one-half the width of such alley may be considered <br />as a portion.~f the side yard. <br />(e) ' `the width of arty side yard provided, whether or not one ~is required by <br />the "Schedula`f Heigk~t and Area Regulations" shaa.l. not be less than three (3) <br />feet. <br />Section` 10. ~„_„ <br />(a) Thai depth required by the "Schedule of Height and Area Regulations" <br />for rear yards ~~,all be the depth exclusive of any portion used for accessory <br />structures. <br />(b) In measuring the depth of a rear yard for any building where such yard <br />extends back to an alley, one-half the width of such alley may be considered as a <br />portion of the yard. <br />(c) In measuring the depth of rear yards, in cases where the rear lot line <br />is not parallel with the attest line, average dimensions may be used. <br />(d) In any Business District, a rear yard at least twenty (20) feet in <br />depth shall be provided for every building used either in whole or in part as a <br />dwelling, or for every lot the rear of which adjoins a Residence District; in <br />ether instances a rear yard shall not be required, except as provided in Section 7 <br />;b) of this article. <br />(e) In any Residence District, no dwelling shall be so located on a lot <br />that the rear thereof faces a street line unless such dwelling be located fifty <br />(50) feet or more from such a street line. <br />Section 11. LOT AREA PER FAMILY. Nothing in the area requirements of this <br />trdinance relating to lot area per family shall be held to prohibit the erection of <br />a one-family dwelling upon a lot, the area of which is less than that prescribed as <br />the lot area per family, provided such lot, .at the time of the passage of this <br />Ordinance, was held under a separate ownership from the adjoining lots; or provided <br />that at the time of the passage of this ordinance, such lot is shown to be a sepa- <br />rate and distinct numbered lot, or a lot of equal area to the ma3ority of lots <br />within five hundred (500) feet thereof, by a plan of lots which has been recorded <br />or which depicts streets or alleys which have been legally dedicated to public use. <br />ARTICLE XIII <br />BOARD OF APPEALS <br />Section 1. C AT ON - MENID, ER~SHIP, <br />(a) A Board of Appeals is hereby established. The word "Board" when used <br />in this ordinance shall be construed to mean the Board of Appeals. <br />(b) The Board shall consist of three members, recommended by the Mayor <br />and appointed by Council.
