24. <br />~~) Where the street layout actually ~n the ground, or as recorded, Differs <br />From the street layout as shown on the Zene Map, the Board shall interpret the map <br />in such`,_~ way as to carry out the intent and purpose of this ordinance and the map <br />for the particular section of district in question. <br />(e~ Where by reason of topographical conditions, District border line <br />situations, immediately adjoining existing developments or because of other unusual <br />circumstances, the strict application of any provision of this ordinance would re- <br />sult in exceptional practical difficulty or undue hardship upon the owner of any <br />specific prdperty, the Board in passing upon appeals, shall have the power to vary <br />or modify such strict application or to interpret the meaning of this ordinance <br />~o as to relieve such difficulty or hardship; provided that such variance, modifi- <br />cation or interpretation shall remain in harmony with the general purpose and in- <br />tent of this ordinance, so that the health, safety and general welfare of the com- <br />munity shall be conserved and substantial justice done. In the exercise of this <br />power the Board may, among other variances, modifications and interpretations, <br />authorize a permit to be issued. <br />1. For the use of land or the erection or use of a building or structure <br />such as a real estate office or a contractors stable or storage yard, for c~saer- <br />aial or industrial purposes in a residence district, in cases where such use is in- <br />cidental and reasonably necessary to the development of the district for residential <br />purposes, and where the proposed use is clearly of a temporary nature, to be aban- <br />domed as the adjacent areas became occupied for residence purposes. Any permit so <br />authorized shall be only for such limited period of time as the Board shall deter- <br />mine is reasonable considering the character of the district in question, and in <br />no case for g period of more than one (1) year. <br />2. For a sand, gravel or clay pit, or a stone quarry, lumbering or sawyer- <br />ing, together with the necessary accessory buildings or structures, in a district <br />restricted against such use by this ordinance, for such period and under such con- <br />ditions as are reasonable, considering the character of the district in question. <br />3. For a reasonable variation of the regulations herein set forth as the <br />Board may deem necessary to the appropriate development of a lot adjacent to a <br />lot, the development of which at the time of the passage of this ordinance does <br />mat conform to the regulations of this ordinance. <br />4. For a reasonable enlargement of a structure existing at the time of <br />tine passage of this ordinance and used for trade or business, but located in a di~- <br />t rict restricted against such use; or for reasonably necessary additional structures <br />for any such use, upon the same lot or plot of ground as that upon which such <br />existing structure and use obtain. <br />
