The Class if led Service shall comprise all gas it ions not <br />specifically included in this Charter in the Unclassified <br />Service. <br />Said rules and procedure applicable in all matters pertaining to <br />the Commission not hereinabove specifically provided for, shall be in <br />accordance with the Constitution of the State of Ohio or the Laws <br />thereof. <br />4. That Section 2(d) of article VII d: the Charter be amended to require <br />the Planning Comtiiseion to act within thirty days on matters either <br />referred to it by Council or presented directly to the Commission, such <br />• amended Section 2(d) to read as follows; <br />"Art isle VII , Sect ion 2 : PLANNING COMMISSION <br />(d) MANLMTORY REFERRAL. No public building, street, <br />boulevard, parkway, park, playground, harbor, dock, wharf, <br />bridge, tunnel, or publicly or privately owned utility or part <br />thereof shall be constructed or authorized to be constructed in <br />the City nor shall any street, avenue, parkway, boulevard or <br />alley be opened for any p~pose whatsoever, nor shall any street, <br />avenue, parkway, boulevard or alley be widened, narrowed, re- <br />located, vacated, or its use changed, or any ordinance ref erring <br />to zoning or other regulations controlling the use or development <br />of land be passed, unless and until it shall have been submitted <br />to theiPlanning Commission for report and recommendation.. Any <br />matter presented to the Planning Commission shall be approved or <br />disapproved by it within thirty (30) days from the date of the <br />• meeting of the Commission, at which such matter was presented, <br />unless a longer time be allowed by Council. If the Planning <br />Commission shall fail to act within the time allotted, it <br />shall be deemed to have approved such matter. Any provision <br />of any and finance, resolution or order disapproved by formal <br />action of the Planning Commission shall require a two-thirds <br />vote of all members of Council eligible to vote for adoption <br />or authoron." <br />• 10. That Section 2 of Article 7X of the Charter be amended to change the <br />date of the municipal primary election from May to September, such <br />amended Section 2 of Article IX to read as follows: <br />"Article IX, Section 2: PRIMARY ELECTIONS <br />On the third Tuesday in September prior to each regular <br />municipal election, primary elections shall be held for the <br />purpose of nominating persons as candidates of political <br />parties for election to offices provided for by this Charter <br />to be voted for at the next succeeding regular municipal <br />election." <br />11. That Section 5 of Article IX of the Charter be amended to increase <br />the number of signatures required for nominating petitions from five <br />to twenty-five, such amended Section 5 of Article IX to read as follows: <br />• "Article LX, Section 5: DECLARATIONS OF CANDIDACY, <br />Each person desiring to become a candidate for a party <br />nomination to be voted for at a primary election, shall, not <br />later than 4:00 P.M. of the 60th day before the day of such <br />primary election, file with the Board of Elections of Guyahoga <br />County, Ohio, a declaration of candidacy and petition, which <br />pet itian shall be signed by not less than twenty-five (25) <br />qualified electors of the City of North Olmsted, who are <br />members of the same political party as the political party of <br />which the candidcate is a member." <br />
