<br />An Ordinance
<br />To levy special assessments for the improvement of Sununerlard Avenue from
<br />Clague'Road to the easterly llrits of-tl -e Village by grading, draining and
<br />slagging sams
<br />Be it ordained by the Council of the Village of Not-th;Oltrsted County
<br />of Cuyahoga and State of Ohio:
<br />Section.l,. That the assessment of the cost and expense of improving
<br />Sur=erland Avenue from Clague Road to the easterly limits of the Village
<br />by grading,, draining and slagging,same
<br />in accordance with the plans and specifications there.6or, amounting in the
<br />aggregate to Five Thousand Eight Hundred' Twenty Three End `80/100- Dollars ($5,823..80)
<br />as reported to this council on�the 12, day'of November , 19 29 ,
<br />by the Village Engineer, notice of the filing.of which assessment has been`'
<br />given as required by law, be and the same is hereby adopted and confirmed,
<br />.and that; there be and is hereby levied upon the lots and lands bounding and
<br />abutting upon said improvement, the.several amounts reported as aforesaid,
<br />which. assessments, -together with the description of said lots and lands,
<br />are now on file in the office of the Clerk of this Council, and which assess -,
<br />ments are at the rate of $3.13246 per foot front, and are not in excess of
<br />the .pecial benefits to said property*
<br />Section 2. Thai: t-he total assessment-against each lot or parcel of land
<br />..shall be payable in case within thirty (30) days from and .after the passage;
<br />of this ordinance, or, at the option of the owner, in five annual install-
<br />menbr witn interest at the rate of 5-1/2 per cunt per annum ,,ll cash pay
<br />menzs shall bo made to tho treasurer of said Village. ';k11 assessments and
<br />installments thereof remaining unpaid at the expiration of said thirty days
<br />shall be certified by the Clerk.of this Council to the County ltudi.tor, as
<br />provided by law, to be by him placed on the tax duplicate and `collectod'as
<br />other taxes are collected,
<br />Section 3. This ordinance shall take effect and be in force from and
<br />after the earliest period allowed by law.
<br />Read the first time December -17, 1929
<br />Moved by Mr. Seltzer seconded by Mr., that the
<br />statutory rule be suspended and that the above ordinance be read immediately'
<br />the second and third'times` and put upon its passage. The affirmative vote on
<br />said motion was as follows: Biddulpl, Bidwell, Christman, ` Seltzer, Schindler,
<br />Stine •
<br />Thereupon the ordinance was read the second and third times and put upon its
<br />passage And the affirmative vote thereon was as follows: Biddulph, Bidwell,
<br />CIx istman, ,Schindler,, Seltzer., Stine.
