PIF Ordinance No. By Mr. AN ORDINANCE DETERMINING TO PROCEED V11TH THE IMPROVE JEN T OF ANDRUS AVENUE, FROM THE BOULEVARD (NORTHERLY END OF AN DRUS AVIN UE) TO KINN EDY RIDGE ROAD, BY GRADING, DRAINING AND SLAGGING SAME. BE IT. ORDAINED by the Council of the _Village of North Olmsted, State of Ohio: i Section 1. That it is hereby determined to proceed With the improvement of Andrus Avenue, from the Boulevard (northerly end of Andrus Avenue) to Kennedy Ridge Road, by grading, draining and slagging same, -in accordance with Resolu- tion No. 1575 passed on the 6th day of September, 1949, and in accordance with the plans, specifications, estimates and Profiles heretofore approved and now on file in, the office of the Clerk. Section 2: That all claims for damages resulting therefrom shall be judiciallyf inquired into after the completion Of the proposed improvement, and the solicitor be, and he is hereby, authorized and directed to institute proceedings in a court of competent jurisdiction to inquire into such claims. Section 3. That the cost of said improvement shall be assessed by the foot front upon the following described lots and .lands, to wit, all lots and lands .bounding and abutting upon the proposed improvement, which said lots and lands are hereby determined to be specially benefited by said improvement; and the cost.of said improvement shall include the expense of pre - liminary and other surveys, of printing and publishing the notices, the cost of construction., together witli interest on notes or bonds issued in anticipation of collection of deferred assessments and all other necessary expenditures. Section 4. That the assessments so to be levied shall be paid in five annual installments., with interest not to exceed -six per cent per annum on deferred payments, provided that the owner of any property assessed may, at.his option, pay such assessment in cash within thirty days from and after the passage Of the assessing ordinance, in which case said assessment shall not include any item of interest upon'notes or bonds to be issued in anticipation of the collection of deferred installments of assessments. . Section 5. That notes or bonds of the Village of North Olmsted shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto. Section 6. That the remainder of the entire cost of said improvement not specially assessed, including the cost: of intersectiohs, shall be paid out of the General Fund or by the issuance of bonds of the Village of North Olmsted for that pur- pose, in the manner provided by law. Section 7. That the Clerk be, and he is hereby, authorized and directed to advertise for bids for the construction of said improvement according to law. Section 8. That this ordinance is hereby declared to be an emergency measure, the emergency being-that it is neces- sary for the immediate preservation of public health,' peace, safety and welfare that, this ordinance be passed at once and shall take effect and be in force from and after its passage.
