PIF <br />Ordinance No. <br />By Mr. <br />AN ORDINANCE <br />DETERMINING TO PROCEED V11TH THE IMPROVE JEN T OF ANDRUS AVENUE, <br />FROM THE BOULEVARD (NORTHERLY END OF AN DRUS AVIN UE) TO KINN EDY <br />RIDGE ROAD, BY GRADING, DRAINING AND SLAGGING SAME. <br />BE IT. ORDAINED by the Council of the _Village of <br />North Olmsted, State of Ohio: <br />i <br />Section 1. That it is hereby determined to proceed <br />With the improvement of Andrus Avenue, from the Boulevard <br />(northerly end of Andrus Avenue) to Kennedy Ridge Road, by <br />grading, draining and slagging same, -in accordance with Resolu- <br />tion No. 1575 passed on the 6th day of September, 1949, and <br />in accordance with the plans, specifications, estimates and <br />Profiles heretofore approved and now on file in, the office of <br />the Clerk. <br />Section 2: That all claims for damages resulting <br />therefrom shall be judiciallyf inquired into after the completion <br />Of the proposed improvement, and the solicitor be, and he is <br />hereby, authorized and directed to institute proceedings in a <br />court of competent jurisdiction to inquire into such claims. <br />Section 3. That the cost of said improvement shall <br />be assessed by the foot front upon the following described lots <br />and .lands, to wit, all lots and lands .bounding and abutting upon <br />the proposed improvement, which said lots and lands are hereby <br />determined to be specially benefited by said improvement; and <br />the cost.of said improvement shall include the expense of pre - <br />liminary and other surveys, of printing and publishing the <br />notices, the cost of construction., together witli interest on <br />notes or bonds issued in anticipation of collection of deferred <br />assessments and all other necessary expenditures. <br />Section 4. That the assessments so to be levied shall <br />be paid in five annual installments., with interest not to exceed <br />-six per cent per annum on deferred payments, provided that the <br />owner of any property assessed may, at.his option, pay such <br />assessment in cash within thirty days from and after the passage <br />Of the assessing ordinance, in which case said assessment shall <br />not include any item of interest upon'notes or bonds to be issued <br />in anticipation of the collection of deferred installments of <br />assessments. . <br />Section 5. That notes or bonds of the Village of <br />North Olmsted shall be issued in anticipation of the collection <br />of assessments by installments and in an amount equal thereto. <br />Section 6. That the remainder of the entire cost of <br />said improvement not specially assessed, including the cost: of <br />intersectiohs, shall be paid out of the General Fund or by the <br />issuance of bonds of the Village of North Olmsted for that pur- <br />pose, in the manner provided by law. <br />Section 7. That the Clerk be, and he is hereby, <br />authorized and directed to advertise for bids for the construction <br />of said improvement according to law. <br />Section 8. That this ordinance is hereby declared to <br />be an emergency measure, the emergency being-that it is neces- <br />sary for the immediate preservation of public health,' peace, <br />safety and welfare that, this ordinance be passed at once and shall <br />take effect and be in force from and after its passage. <br />Passed: March 7, 1950. <br />Mayor <br />ls� <br />9� <br />
