Ordinance No. By Mr. AN ORDIN AN CE DETEMUNING TO PROCEED WITH THE IMPROVEMENT OF SILVERDALE ROAD, FROM LORAIN ROAD TO THE NORTH LINE OF SUBLOT NO. 29, BY CON STRM CT IN G THEREIN A V`IATER LINE. BE IT ORDAINED by the Council of the Village of North Olmsted, State of Ohio: Section 1. That it is hereby determined to pro- ceed with the improvement of Silverdale Road, from Lorain Road to the North Line of Sublot No. 29, by constructing therein a water line, in accordance with Resolution No. 1570 passed on the 2nd day of August, 1949, and in accordance with the Plans., specifications, estimates and profiles heretofore approved and now on file in the office of the Clerk.. Section 2, That all claims for damages result- Ing therefrom shall be judicially inquired into offer the completion of the proposed improvement, and the solicitor be, and he is hereby, authorized and directed to institute proceed- ings in a court of competent jurisdiction to inquire into such claims. Section 3. That the cost of said: improvement shall be assessed by the foot front upon the following de- scribed lots and lands, to wit, all lots 'and lands bounding and abutting upon the proposed improvement, which said lots and lands are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall in elude the expense of preliminary and other surveys, of printing and publishing the notices, resolutions and ordinances .required, the serving of said notices, the cost of construction, together with interest on notes or bonds issued in anticipation of collection of deferred assessments and all other necessary expenditures. Section 4. That the assessments so to be levied shall be paid in ten annual installments, with interest notto exceed six per cent per annum on deferred payments, provided, that the owner of any property assessed may, at his option, Pay such assessment in cash within thirty days from and after the passage of the assessing ordinance, in which case said assessment shall not include any item of interest upon notes or bonds to be issued in anticipation of the collection` of deferred installments of assessments. Section 5. That notes or bonds of the Village of North Olmsted shall be issued in . anticipation of the collection Of assessments by installments and in an' amount equal thereto. Section 6. This ordinance is hereby declared to be an emergency measure, necessary for the immediate preserva- tion of public health, peace, safety and welfare, and shall take effect and be in force from and after its passage.
