Ordinance No, 780 <br />By Mr. <br />AN 0 RDI NAN CE <br />PROHIBITING UNNECESSARY NOISES <br />BE IT ORDAINED by the Council of the Village of <br />North Olmsted, *State of Ohio: <br />Section 1. No person, firm or corporation shall <br />operate or cause to be'operated any sound amplifying device <br />or devices,other than warning signals, mounted upon any <br />vehicle propelled over the streets and highways of the Village <br />Of North Olmsted or stationed thereon or so close thereto as <br />to obstruct, annoy or disturb-persons upon the streets, <br />highways or public places, unless a special- permit has been <br />duly issued by the Mayor as hereinafter provided. <br />Section 2, The Mayor may issue a permit to operate <br />a sound amplifying device mounted upon a vehicle to be operated <br />through the streets of the Village of North Olmsted, but only <br />for the purpose of advertising the doings of charitable <br />organizations. <br />Section 3. Every person, firm or corporation desir- <br />ing a permit to operate a sound amplifying device mounted <br />Upon a vehicle shall make an application therefor to the Mayor <br />Upon forms to be prescribed by him. <br />Section 40 The follovaing fees shall be charged for <br />the permit and inspection of equipment: <br />$1.00 for each day's operation. <br />Section,5. From and after the effective date of this <br />ordinance it shall be unlawful to -use any drum, loud speaker or <br />Other instrivnent or device for the purpose of attracting-' atten <br />Lion by creation of noise, show or display, except where a <br />special permit has been issued therefor, by the Mayor. <br />Section 6, From and after the effective date of this <br />ordinance, no person shall, between the hours of 7 :00 A.M. and <br />10:00 P.M, blow or cause to be blown any whistle, horn or other <br />noise making instrument calling attention to goods, wares and <br />merchandise offered for sale from drays, carts or baskets upon <br />the streets of the Village of North Olmsted or on the outside <br />Of any house or building therein; and no person shall on Sunday <br />use any noise-making instrument for the purpose of announcing <br />or calling out in a voice greater than ordinary conversational <br />tones the sale of any merchandise or the announcing of any <br />doings except when a permit has been issued by the Mayor as <br />hereinbefore set forth. <br />Section 7. Any person, firm <br />or <br />'corporation violating <br />any of the provisions of: this ordinance shall be guilty of a <br />misdemeanor and upon conviction .thereof shall be fined not to <br />8xc88d $50.00. <br />Section 8. This ordinance is hereby declared to be <br />an emergency measure, the emergency being that it is necessary <br />for the immediate preservation of -public health, peace, safety <br />and welfare that this ordinance be passed at once and shall take <br />'ffect,;.and be;-in force from and after its passage. <br />Passed: Octobers 4, 1949. <br />C er Mayor <br />
