5 <br />Resolution No. 1033 <br />By Mr. <br />- A RESOLUTIOPd <br />TO LEVY A SPECIAL ASSESS1aNT UPON ALL LOTS, LANDS AND REAL <br />PROPERTY Z "aTTRIN THE VILLAGE OF NORTH OLNISTED, OHIO, FOR THE <br />FURNISHING OF STREET LIGHTING. <br />WHEREAS this council finds it necessary to <br />levy special assessments for the cost of lighting streets and <br />highways in the Village of North Olmsted for a period of one <br />year, <br />NUN.. THEREF OPE, BE IT RESOLVED by the Council <br />of the Village of North Olmsted, Ohio: <br />Section 1. That there be and'is hereby <br />levied upon all the lots, lands and real prop erty.within the <br />Village of North Olmsted, Ohio,.a special assessment for the <br />purpose of paying the cost of street lighting within said <br />Village. Said assessment shall be for the period of one year, - <br />the tax year 1939, and shall be for the aggregate amount of <br />$1318.23 and shall be collected as other taxes and assessments <br />are collected. Said special assessment shall be and is hereby <br />levied by a percentage of the tax value.of each lot, parcel of <br />land or real property to be so assessed and for the tax year <br />1939 shall be equal to .00034 per cent of each dollar of the <br />1938 value <br />Section 2. That this council finds said <br />assessment to be within all limitations provided by law, and <br />that such is the fact as to each lot and parcel to be so <br />assessed; that all provisions of law necessary to the lawful <br />levy of said assessment have been fully complied with and that <br />said assessment is not in any case in excess of the benefit <br />conferred upon the lots, lands or real property being assessed. <br />Section 3. That the total assessment-against <br />any lot, parcel or property may be paid in cash to the Treasurer <br />of this Village within thirty days of the passage of this <br />resolution and any amount so paid,shall be credited to the <br />Street Lighting Fund of the Village and any and all receipts <br />resulting from the assessment herein levied and ordered shall <br />be credited to said fund and shall be used for no purpose what- <br />soever other than payment of °_the cost of the street lighting <br />herein specifically referred to. Any assessment not paid within <br />thirty days next following the passage of this ordinance shall <br />be certified to , the County Auditor of Cuyahoga County, as <br />provided by law, to be by him placed on the tax duplicate for <br />collection as herein provided and contemplated. <br />Section 4. This resolution shall be in full <br />force and effect . from and after the earliest period alloyed by <br />law . <br />Passed: August 1, 1939. <br />-C erk _ 1, or <br />
