-2- <br />Ys. Ja.mes Hink-el stated he put up a political sign not knowing <br />he needed a permit. Ne then requested a written permit for the <br />' <br />sign. . <br />;;Tr. iiitson stated Y!e had a letter from Iti4ayor Lewis that it was <br />necessary for him to appear before Council for a permit to erect <br />a political sign. Under Ordinance -#122, Section 243, 14r. Kitson <br />then stated that it is his opinion, as Solicitor, th?:t the <br />ordinance referred to was repealed by inference in the,present <br />Zoning Ordinance No. 1011. If it had been otrerwise the wording <br />of the ordinar_ce`cited would have been carried into'the present <br />Zonins Ordinance, In Article XVII of the Zoning Ordinance <br />122 and "a11 other Crdinances or parts of Grdinances in <br />conflict herewith or'contrary hereto, be and the'same are <br />hereby repealed". `There is not one vlord in the Zoning Ordinance <br />about the necessity.of any Resolution by Council. - <br />Aga3.n, if we refer to the codified copy of the ordinances on . <br />pageā¢9, Section 243, entitled °Si?ns ar.d Billboards", you will <br />notice the former Solicitar, Mr. 'Viheeler, mere)_y refers to the <br />Ordinance quoted by the T,:ayor v??ith the ?rords t? See Zoning Ordinance <br />10i1", instead of copyin-g the section in its°entirety, which <br />clearlg indicates hia opinion that the present Zonin.g Ordinance <br />control.s, and the ordinance in question is no ].onger effective. <br />The 1`11ayor reported that the Pastor of the Baptist Church requested <br />permission to put up a tent for a weeks meeting on their property <br />on Lorain Road west of Stearns Road. The Mayor reported that Llary Caine of 4776 Lansing Drive had . <br />taken out a permit to build a house. The excavation was made <br />and the blocz had been laid and it was filled with Vvater four - <br />to five feet deep. It being dangerous to children, the question <br />arose to whose responsibility it was to back fill or fe.nce it in. <br />The btiildina Commissioner had contacted Mrs. Caine and she <br />stated she could not stand the expense of having it filled. The <br />matter was ther_ referred to tha aolicitor for recommendation. <br />The Engineer reForted that the netition for eradin?, draining, <br />and pati?ing Decker F.oad from Zorain Raad to Liidvale did not have <br />the required sixty percent of signitures.
