The Contractor shall conduct operations under his contract in compliance with all applicable Federal, <br /> State and Local laws; provided, however,that the general specifications shall govern the obligations of <br /> the Contractor where there exist conflicting ordinances of the City on the subject.The City expects that <br /> the Contractor both understands and will follow all of the laws and regulations governing biosolids <br /> transportation and disposal. This includes but is not limited to using sealed tailgates and tarps on all <br /> loads being removed from the facility. This also includes anY laws and regulations pertaining to NPDES <br /> permitting. <br /> WORK BY THE CITY DURING THE CONTRACT PERIOD <br /> The City reserves the right to separately haul and/or dispose of some or all of the WWTP biosolids to the <br /> identified disposal site or alternative disposal sites. The reservation of this right is necessary for the City <br /> to be able to be continually assured that the combination of the solids stream unit processes operation <br /> and the wastewater treatment biosolids disposal activities represent the least cost, environmentally <br /> acceptable and sound manner available at any given time to the city. <br /> OFFICE <br /> The contractor shall maintain an office or other such facilities through which he can be contacted. It <br /> shall be equipped with sufficient telephones and shall have a responsible person in charge from 8:00 am <br /> to 4:30 pm on regular collection days. <br /> COMPETENCY OF BIDDER <br /> The opening and reading of the Bid Proposal shall not be construed as an acceptance of the bidder as a <br /> qualified, responsible bidder. The City reserves the right to determine the competence and <br /> responsibility of a bidder from its knowledge of the bidder's qualifications or from other sources. <br /> CERTIFIED SUPPORTING DATA <br /> The City shall require submission with the Bid Proposal supporting data regarding the qualifications of <br /> the bidder in order to determine whether he is a qualified, responsible bidder. The bidder will be <br /> required to furnish all of the following information: <br /> • An itemized list of the Bidder's equipment available for use on the Contract; <br /> • An adequate demonstration of financial responsibility which may include in the Safety Director's <br /> discretion, a certified financial statement prepared by a certified public accountant, to assure <br /> that the bidder possesses adequate resources and availability of credit and the means and <br /> ability to procure insurance and bonds required for the project. <br /> • Evidence that the Bidder is in good standing in the State of Ohio, and in the case of a <br /> corporation organized under the laws of any other State, evidence that the Bidder is licensed to <br /> do business in the State of Ohio or a sworn statement that it will take all necessary action to <br /> become so licensed if its proposal is accepted; <br /> • Evidence in form and substance satisfactory to City that Bidder has been in existence as a going <br /> concern for in excess of five (5) years and possesses not less than five (5)years actual operating <br /> experience as a going concern in biosolids collection and disposal from a comparable size <br /> municipality; <br /> • Evidence in form and substance satisfactory to the City that Bidder has the capacity to <br /> accommodate the anticipated volume for a minimum of five(5)years at designated disposal site <br /> as described in the bid. <br /> NOWWTP 2014 BIOSOLIDS BID SPECIFICATIONS <br />
