The Contractor shall conduct operations under his contract in compliance with all applicable Federal, State and Local laws; provided, however,that the general specifications shall govern the obligations of the Contractor where there exist conflicting ordinances of the City on the subject.The City expects that the Contractor both understands and will follow all of the laws and regulations governing biosolids transportation and disposal. This includes but is not limited to using sealed tailgates and tarps on all loads being removed from the facility. This also includes anY laws and regulations pertaining to NPDES permitting. WORK BY THE CITY DURING THE CONTRACT PERIOD The City reserves the right to separately haul and/or dispose of some or all of the WWTP biosolids to the identified disposal site or alternative disposal sites. The reservation of this right is necessary for the City to be able to be continually assured that the combination of the solids stream unit processes operation and the wastewater treatment biosolids disposal activities represent the least cost, environmentally acceptable and sound manner available at any given time to the city. OFFICE The contractor shall maintain an office or other such facilities through which he can be contacted. It shall be equipped with sufficient telephones and shall have a responsible person in charge from 8:00 am to 4:30 pm on regular collection days. COMPETENCY OF BIDDER The opening and reading of the Bid Proposal shall not be construed as an acceptance of the bidder as a qualified, responsible bidder. The City reserves the right to determine the competence and responsibility of a bidder from its knowledge of the bidder's qualifications or from other sources. CERTIFIED SUPPORTING DATA The City shall require submission with the Bid Proposal supporting data regarding the qualifications of the bidder in order to determine whether he is a qualified, responsible bidder. The bidder will be required to furnish all of the following information: • An itemized list of the Bidder's equipment available for use on the Contract; • An adequate demonstration of financial responsibility which may include in the Safety Director's discretion, a certified financial statement prepared by a certified public accountant, to assure that the bidder possesses adequate resources and availability of credit and the means and ability to procure insurance and bonds required for the project. • Evidence that the Bidder is in good standing in the State of Ohio, and in the case of a corporation organized under the laws of any other State, evidence that the Bidder is licensed to do business in the State of Ohio or a sworn statement that it will take all necessary action to become so licensed if its proposal is accepted; • Evidence in form and substance satisfactory to City that Bidder has been in existence as a going concern for in excess of five (5) years and possesses not less than five (5)years actual operating experience as a going concern in biosolids collection and disposal from a comparable size municipality; • Evidence in form and substance satisfactory to the City that Bidder has the capacity to accommodate the anticipated volume for a minimum of five(5)years at designated disposal site as described in the bid.
