Council Minutes of 10-01-2013 The Public Safety Committee met Tuesday September 24, 2013 at 8:54p.m. Present were committee members Williamson, Smith & Schumann; Council President Jones; Council members Barker, Brossard, Kearney and Orlowski; Law Director Gareau, Finance Director Copfer and guests. • Liquor Permit No. 73935330305 (liquor agency contract) for Riser Foods Company DBA Giant Eagle #6359 located at 27264 Lorain Road. Sgt. Wagner reviewed the application and found no concerns. The committee voted 3-0 to not object to this liquor permit. Councilwoman Williamson made a motion to not object to liquor permit no. 73935330305 Riser Foods Company DBA Giant Eagle #6359 located at 27264 Lorain Road. The motion was seconded by Councilman Schumann and passed unanimously. Liquor permit approved. • Liquor Permit No. 0766781 (transfer) for Blue Turtle Tavern, LLC located at 29352 Lorain Road. Sgt. Wagner reviewed the application and found no concerns. The committee voted 3-0 to not object to this liquor permit. Councilwoman Williamson made a motion to not object to liquor permit no. 0766781 Blue Turtle Tavern, LLC located at 27264 Lorain Road. The motion was seconded by Councilman Smith and passed unanimously. Liquor permit approved. • Discussed next was Ordinance 2013-83 which is an Ordinance amending Chapter '44ar. 513 of the General Offenses Code of the Codified Ordinances of the City of North Olmsted entitled "Drug Abuse Control" in order to create a local Code provision making illegal the possession of marijuana drug paraphernalia. Law Director Gareau explained that the State of Ohio currently has Codes that address drug paraphernalia and drug abuse instruments. The city also regulates drug abuse instruments with the exception of marihuana. The Law Director and city Prosecutor have discussed the creation of this Section to address the charging of marihuana drug paraphernalia and agree that this Section is necessary to property charge these types of cases. This proposed Ordinance Section mirrors the State Code and creates a local prohibition for the possession of or use of marihuana paraphernalia with a less restrictive penalty. Motion made by Williamson second by Smith. The committee voted 2-1 (Schumann, no) to recommend approval of Ordinance 2013-83. • Discussed last was Ordinance 2013-84 which is an Ordinance amending Section 351.20 of the Traffic Code of the City of North Olmsted entitled "Handicapped Parking" in order to establish jurisdiction in the North Olmsted Mayor's Court for the prosecution of handicapped parking ticket violations, and declaring an emergency. The current Code Section grants Rocky River Municipal Court with the sole jurisdiction to prosecute offenses for this particular Code Section. The amendment allows for the violations of this Section to be also handled in the North Olmsted Mayor's Court. Questions regarding other possible amendments to this Section were made. However, it was decided to revisit those suggestions `w in the future and to focus on the current amendment before Council. Motion 3
