Council Minutes of 05 -20 -2014 The Safety Committee met Wednesday May 14, 2014 at 7:30 p.m. Present were committee members Barker and Brossard; Council members Hemann, Kearney and Schumann; Mayor Kennedy, Finance Director Copfer, Law Director Gareau and guests. • Discussed was liquor permit no. 6759950 for Discount Tobacco and Beverage located at 23146 Lorain Road. Sgt. Wagner of the North Olmsted Police Dept. has completed a background investigation of this applicant and offers no objection to this permit. Councilman Barker made a motion to not object. The motion was seconded by Councilman Brossard and the committee voted 2 -0 to recommend to Council to not object to this liquor permit. Councilman Barker made a motion to not object to liquor permit no. 6759950 for Discount Tobacco and Beverage located at 23146 Lorain Road. The motion was seconded by Councilwoman Williamson and passed unanimously. Liquor permit approved 6 -0. • Discussed next was Ordinance 2014 -35 which is and Ordinance amending Section 537.17 of Chapter 537 of the General Offenses Code entitled "Criminal Child Enticement" in order to clarify prohibited conduct, and declaring an emergency. Last week the Ohio Supreme Court ruled that certain prohibitions against child enticement as previously contained in ORC 2905.05 were unconstitutionally vague and overly broad. The state legislature amended the ORC as the city is now changing their Code to mirror the state's Code. A motion was made by Councilman Barker to recommend approval. The motion was seconded by Councilman Brossard and the committee voted 2 -0 to recommend approval of Ordinance 2014 -35. Councilman Kearney, Chairman of the Finance Committee: The Finance Committee met Wednesday May 14, 2014 at 7:00 p.m. Present were committee members Kearney, Schumann and Barker; Council members Hemann and Limpert; Law Director Gareau, Finance Director Copfer and Safety /Service Director Glauner. • Discussed first was Ordinance 2014 -31 which is an Ordinance amending Section 161.01 of the Codified Ordinances of the City of North Olmsted entitled "Employees Generally" for the purpose of acknowledging and accepting, upon hire, employee sick time accrued with another governmental agency and further establishing an additional restriction for payout of sick leave upon death, disability or retirement. This limits the maximum payout to 240 hours. The committee voted 3 -0 to recommend approval of Ordinance 2014 -31. • Discussed next was Ordinance 2014 -32 which is an Ordinance to make and transfer appropriations for current expenses and other expenditures for the City of North Olmsted for the year ending December 31, 2014, and declaring an emergency, as amended. Worksheet attached. The committee voted 3 -0 to recommend approval of Ordinance 2014 -32 with suspension. Councilman Kearney made a motion to amend Ordinance 2014 -32.
