Council Minutes of 10 -07 -2014 <br />• Discussed was Ordinance 2014 -66 which is an Ordinance dispensing with a <br />formal RFP process and authorizing the Mayor to enter into an agreement with <br />American Healthways Services, LLC, to provide marketing services related to <br />Recreation Center fitness programs for the City of North Olmsted, and declaring <br />an emergency. The Silver Sneaker and Prime fitness programs will pay the <br />Recreation Center when their members use the fitness center. It will allow free <br />access for certain seniors and federal government employees who are eligible, <br />which will keep them active and healthy. The committee voted 2 -0 to recommend <br />approval of Ordinance 2014 -66 with suspension. <br />Councilman Schumann, Chairman of the Building, Zoning & Development Committee; <br />The BZD Committee met Tuesday September 30, 2014 at 7:00 p.m. Present were <br />committee members Schumann, Barker and Williamson; Council members Brossard, <br />Hemann, Kearney and Limpert; Planning /Development Director Wenger, Law Director <br />Gareau and design professional, Brian Fabo. <br />• Discussed was CMS 14 -59 26324 Lorain Road. This is the location that is to <br />become a Levin Mattress store. Director Wenger explained the project including <br />improvements to the existing building and changes to the parking and driveways <br />and an addition of an exit onto Silverdale. The Law Director explained the need <br />to amend the existing Declaration of Restrictions on the deed to allow for this <br />change. He also suggested a separate vote to amend the Declaration of <br />Restrictions this evening. <br />Councilman Schumann made a motion to give consent to the filing of the amended <br />Declaration of Restrictions, which Declaration amends the original Declaration of <br />Restrictions filed with the Cuyahoga County Recorder's Office on December 18, 1990 <br />and recorded at Volume 90 -7826, Page 12. This consent is conditioned upon the filing of <br />the amended Declaration of Restrictions and further conditioned upon those terms set <br />forth therein. He requested that the amended Declaration of Restrictions be made a part <br />of the minutes of this Council meeting. The motion was seconded by Councilwoman <br />Williamson and passed unanimously. Declaration of Restrictions amended 7 -0. <br />Councilman Schumann made a motion to approve CMS14 -59 26324 Lorain Road <br />project. The motion was seconded by Councilwoman Williamson and passed <br />unanimously. CMS 14 -59 approved 7 -0. <br />The BZD Committee met Tuesday October 7, 2014 at 7:00 p.m. Present were committee <br />members Schumann, Barker and Williamson; Council members Brossard, Hemann, <br />Kearney and Limpert; Mayor Kennedy, Planning /Development Director Wenger, <br />Safety /Service Director Glauner and guests. <br />• Discussed first was CMS14 -1146 Popeye's Restaurant located at 26170 Lorain <br />Road. Director Wenger explained the changes and planning recommendations. <br />The neighbors voiced their concerns which were discussed and dealt with by the <br />Planning and Design Commission. Councilman Schumann made a motion to <br />recommend approval of this project. The motion was seconded by <br />Councilwoman Williamson, and the committee voted 3 -0 to recommend approval <br />of CMS 14 -1146. <br />E <br />
