Council Minutes of 08-04-2015 <br /> • (St. Richard/North Olmsted Middle School, which was also discussed at this <br /> committee meeting, was given a report at the special Council meeting of June 23, <br /> 2015) <br /> AUDIENCE PARTICIPATION <br /> Dennis Lambert, 25057 Carey Lane welcomed Council back to regular session. He <br /> referenced legislation that deals with renting out rooms. Apparently the city is going to <br /> be "Big Brother". If mom moves in because she can no longer take care of her own <br /> house and she compensates you, you will be renting out a room and subject to those rules. <br /> Probate Court authorizes so much money for expenditures for a guardianship, and you <br /> have to declare this as part of your income tax every year. This cannot be argued that this <br /> is just a family issue. He requested that the language be simplified. He referenced the <br /> legislation that deals with interior maintenance. This gives the building inspector the <br /> authority to vacate houses that are declared uninhabitable. It sounds like a nice idea until <br /> a street of homes becomes flooded with raw sewage. This legislation needs to be applied <br /> across the board, and everyone on that street needs to vacate their homes until the <br /> basements are disinfected. He asked Council to take a close look at the ramifications of <br /> this legislation before it is voted upon. Councilman Schumann asked Lambert how much <br /> he charges his mother to live in his home. Lambert argued that the question is personal, <br /> but he is his mother's guardian and he does not take a nickel from her. The lawyer thinks <br /> he's crazy. Lambert clarified that his mother does not live with him; she's in independent <br /> living. He was told by the attorney that if he takes her money, he would have to declare <br /> it as income tax. Councilman Schumann said he hopes he would. Law Director Gareau <br /> said that they have been licensing rental units in North Olmsted since 2006. They are <br /> simply relocating that section of the Code to an additional section. They have never gone <br /> after anyone's mother or acted under any scenario that Lambert presented. It's extreme <br /> and illogical to suggest that the city will go after somebody's mother-in-law, etc. <br /> Councilwoman Williamson stated that this conversation should be had during the <br /> committee meeting next Tuesday when the Ordinance will be discussed and everyone <br /> will have an opportunity to express their concerns and discuss any changes that will be <br /> made. <br /> Mike Kish, 6125/6115 Barton Road he attended the June 16, 2015 Council meeting and <br /> voiced his concerns about repairing tree lawns for the gas replacement project. He sent a <br /> letter to the Mayor on July 6, 2015 and has not received a response from him. On July <br /> 30, 2015 he received a call from Dave Wendell informing him that the grading stopped <br /> about a foot back from the sidewalk, which he disagrees with, and that he would have to <br /> contact the contractor in order to get the grading redone at that property. He sent another <br /> letter today voicing his concerns about the lack of communication among departments in <br /> North Olmsted to rectify this situation. He has contacted the Cleveland Water Dept. to <br /> have them regrade and repair the curb valve boxes that were damaged when they did the <br /> sidewalk replacement. <br /> Henry Gabriel, 4685 Canterbury Road referenced the noise coming from Morris Cadillac. <br /> He is requesting that before this business comes to the city for variances, can they adhere <br /> to ordinances first. Law Director Gareau suggested that he direct his concerns to <br /> Council. He overhead a representative from Morris tell his neighbor that the noise is <br /> 3 <br />
