It is possible that this can be appealed, but such situations <br /> are extremely rare. <br /> • The brief of appellant was filed yesterday in the matter of Brian Bielozer vs. the <br /> City of North Olmsted in the United States Federal District Court. The city's <br /> response is due October 5, 2015. This is Mr. Bielozer's appeal from a judgement <br /> rendered in favor of the city on all counts that were presented in a civil suit <br /> against the City of North Olmsted by Mr. Bielozer and his wife. <br /> • In fair housing, HUD conducted an audit last week of operations in the City of <br /> North Olmsted, and all went very well. Ass't Director of Law Heyward has <br /> participated in additional training related to fair housing matters, including <br /> attending training in Washington D.C. over the summer. <br /> • Concerning Ordinance 2015-78, this was originally presented in Ordinance 2015- <br /> 44. The Board of Elections contacted him and expressed concern with the <br /> primary filing deadline language. Ordinance 2015-78 clarifies this by specifically <br /> stating it will be 90 days before the primary established, even though there <br /> wouldn't be a primary. That would be the language to use to establish a filing <br /> deadline. This Ordinance also repeals Ordinance 2015-44. There is a request to <br /> pass this under suspension this evening so that the Clerk can get this down to the <br /> Board of Elections by Friday. <br /> Director of Finance Copfer: <br /> • She received many positive comments about the Popular Annual Financial Report <br /> that was mailed to every home. It was well received and the residents appreciate <br /> the annual update in a format they can understand. <br /> • The May month end detailed and summary financial statements were E-mailed to <br /> council on August 26, 2015. They have June preliminarily completed, but she is <br /> reviewing the results and will be providing written comments shortly. <br /> • She is completing the work on the Annual Information Filing that is required to be <br /> filed by the end of September for the ongoing bond disclosure. <br /> • She plans on bonding out the $5 million in Notes the currently have outstanding <br /> that are due in February 2016 but have a call date of August 1, 2015. Currently, <br /> two pieces of the 2006 Bond issue are refundable and would save around <br /> $300,000 after all costs are considered based on an analysis done last week. <br /> These estimates will change with the market. This legislation will hopefully be <br /> completed in time for the next Council meeting. <br /> Councilman Barker, Chairman of the Public Health, Safety & Welfare Committee: <br /> The Public Safety Committee met Tuesday, August 25, 2015 at 7:15 p.m. Present were <br /> committee members Barker and Williamson; Council members Hemann, Kearney and <br /> Schumann; Safety/Service Director Glauner and Law Director Gareau. <br /> • Discussed was Ordinance 2051-67 which is an Ordinance enacting new Chapter <br /> 949 of the Streets, Utilities and Public Services Code entitled "Animal Control <br /> and Nuisance Abatement" in order to establish procedures for animal control and <br /> cost recovery. This new Chapter is to help provide for animal control for vacant <br /> houses and properties. If a nuisance is determined, this Section helps in notifying <br /> the owners — be it bank or individual owner — to remove the "critter" problem or <br /> the City will hire a licensed professional to take care of the nuisance and the bill <br /> 2 <br />
