Council Minutes of 02-02-2016 The Public Safety, Health and Welfare Committee met on Tuesday, January 26, 2016 at 7:35 p.m. Present were committee members Barker, Williamson and Brossard; Council members Hemann, Kearney, Limpert and Schumann; and guests. • Discussed was liquor permit number 0351686 for B & H Resources LLC, DBA Easy Flo Gas located at 28925 Lorain Road. This pertains to a change of LLC membership. There were no objections from the Police Dept. The committee voted 3-0 to not object to this liquor permit. The meeting was adjourned at 7:38 p.m. Councilwoman Williamson made a motion to not object to liquor permit 0351686 Easy Flo Gas located at 28925 Lorain Road. The motion was seconded by Councilman Brossard and passed unanimously. Liquor permit approved 6-0. Councilman Schumann, Chairman of the Building, Zoning & Development Committee: The BZD Committee met Tuesday, January 26, 2016 at 7:00 p.m. Present were committee members Schumann, Barker & Williamson; Council members Hemann, Kearney and Limpert; Mayor Kennedy, Planning & Development Director Wenger and guests. The Mayor announced at the beginning of the meeting that Kim Wenger was presented with the "Awesomeness Award" for her role in the city's Bicentennial Celebration during 2015. Councilman Schumann congratulated Director Wenger. • Discussed first was CMS15-4683 Permanent Parcel No. 237-09-005 Dollar General. This is a proposal to construct a new store on a parcel south of Lorain Road on the east side of Clague Road. The lot is zoned general retail, and the applicant has met most of the conditions set forth by the Planning & Design Commission during the planning phase. There was some discussion about two existing curb cuts and potential traffic problems, but the plan was met with general acceptance. There is an access easement through the CVS lot. The committee voted 3-0 to recommend CMS15-4683 Dollar General. Councilman Schumann made a motion to approve CMS15-4683 Dollar General subject to recommendations set forth by the Planning & Design Commission, especially the no merchandise for sale outside of the store requirement. The motion was seconded by Councilwoman Williamson and passed unanimously. CMS 15-4683 Dollar General approved 6-0. • Discussed last was Resolution 2016-3 which is a Resolution authorizing the Mayor to enter into an amended agreement with LSL Planning/SAFEbuilt Ohio, LLC, to provide additional professional planning and zoning services to the city on the Zoning Code Update Project, and declaring an emergency. This will help to fund the Commercial Zoning Code rehabilitation and changes which were researched and suggested by this same firm in a preliminary report last year. The intent is to clean up the Code and to create multiple zoning districts to replace the single general retail district the city has now. There will be several pieces of legislation that will be presented to Council over the course of this year. The cost will be $40,000. The committee voted 3-0 to recommend approval of Resolution 2016-3 with suspension. 3
