Council Minutes of 05-03-2016 <br /> The BZD Committee met Tuesday, April 26, 2016 at 7:15 p.m. Present were committee <br /> members Schumann and Barker; Council President Jones; Council members Brossard, <br /> Hemann, Kearney and Limpert; Mayor Kennedy and Planning & Development Director <br /> Wenger. <br /> • Discussed was Ordinance 2016-49 which is an Ordinance amending various <br /> sections of Part Seven of the Codified Ordinances of the City of North Olmsted <br /> titled "Business Regulation Code" for the limited purpose of changing the "Board <br /> of Building Code Appeals" and "Board of Zoning Appeals" to the "Building and <br /> Zoning Board of Appeals" and declaring an emergency. This Ordinance amends <br /> the Code to conform with the recent Charter changes. The Committee voted 2-0 <br /> to recommend approval of Ordinance 2016-49. <br /> • Discussed last was Ordinance 2016-19 which is an Ordinance establishing <br /> Chapter 735 of the Business Regulation Code entitled "Food Trucks" to provide <br /> regulations for mobile food vendors in the City of North Olmsted. Food trucks <br /> must be licensed by the State of Ohio, and must have a license issued by the <br /> Cuyahoga County Board of Health. Food trucks must make themselves available <br /> for inspection by the Division of Fire, must keep the surrounding area clean, and <br /> not have loudspeakers or alcohol. Food trucks are prohibited from operating in <br /> the public right-of-way. Ice cream trucks are excluded from this legislation. The <br /> committee voted 2-0 to recommend approval of Ordinance 2016-19 with <br /> amendments. <br /> Councilman Schumann made a motion to amend Ordinance 2016-19. The motion was <br /> seconded by Councilman Barker and passed unanimously. Ordinance 2016-19 amended <br /> 7-0. <br /> Councilwoman Hemann, Chairwoman of the Intra-Governmental Relations Committee <br /> amended her report given at the April 19, 2016 Council meeting where she stated Mayor <br /> Kennedy was present at the Intra-Governmental Relations Committee meeting of April <br /> 12, 2016 when, in fact, he was not. <br /> AUDIENCE PARTICIPATION <br /> Dennis Lambert, 25057 Carey Lane said he has come up to say something nice about the <br /> Law Director. Keeping Council up-to-date with litigation is probably one of the most <br /> important things a Law Director can do. Lambert said he appreciates Gareau being <br /> proactive about that. What is interesting about this particular case is he gets so many <br /> people that think he's "off the wall" when he comes to Council meetings with ideas. He <br /> addressed Gareau and asked him if he recalls when the Council started using electronic <br /> tablets (iPads), he spoke of the potential risk of having those tablets be scrutinized by <br /> anybody. The Supreme Court kind of nails that prediction. <br /> LEGISLATION <br /> Ordinance 2016-37 introduced by Mayor Kennedy was given its third reading. An <br /> Ordinance amending various sections of Chapter Thirteen of the Codified Ordinances of <br /> 3 <br />
