The motion was seconded by Councilman Brossard, and the <br /> committee voted 3-0 to recommend approval of Resolution 2016-79 with <br /> suspension. <br /> AUDIENCE PARTICIPATION <br /> Ms. Cehelnik, 5846 Mackenzie said that the bike trail between Butternut Ridge Road and <br /> Country Club Boulevard is a mess. There are trees that have been down for three to four <br /> years. She had informed the city and nothing has been done. It used to be a beautiful <br /> bike trail. Big branches have fallen and the fence is bent. Mayor Kennedy said he has <br /> received several calls from people regarding the bike trail. He said the city will get out <br /> there and take care of it. Law Director Gareau asked about the condition of the asphalt. <br /> Ms. Cehelnik said the tree roots have raised different areas of the trail. Plus there is trash <br /> from 1-480 on the other side of the fence. <br /> Dennis Lambert, 25057 Carey Lane said he is here to talk about the integrity of Council <br /> as a body. Ordinance 2016-76 will be assigned to the Committee of the Whole. Most <br /> legislative bodies to not have a "Committee of the Whole". The "Whole" is a fact- <br /> finding group that gets together. He cannot recall a Committee of the Whole meeting <br /> ever being conducted under Boehmer or Saringer. 2016-76 should be in the Building, <br /> Zoning & Development Committee because it deals with community development. Most <br /> Councils have a Planning, Zoning and Development Committee. Or, 2016-76 should be <br /> in Finance Committee. A good Council President delegates authority to other people and <br /> gets things done through them. They don't do it themselves. The first Council President <br /> he recalls using Committee of the Whole was O'Grady. He enjoyed his time in front of <br /> the audience. This should be assigned to a specific committee unless the Committee of <br /> the Whole wants to interrogate somebody, question somebody as a body or get input <br /> from an entire city regarding an issue. This is bad management and bad legislating. <br /> LEGISLATION <br /> Ordinance 2016-36 introduced by Mayor Kennedy was given its third reading. An <br /> Ordinance amending various sections of Chapter Eleven of the Codified Ordinances of <br /> the City of North Olmsted titled"Planning and Zoning Code" for the purpose of changing <br /> the "Board of Zoning Appeals" to the "Building and Zoning Board of Appeals" and for <br /> the further purpose of eliminating reference to the defunct Architectural Review Board. <br /> Councilman Schumann moved for adoption. The motion was seconded by <br /> Councilwoman Williamson and passed unanimously. Ordinance 2016-36 adopted 7-0. <br /> Resolution 2016-68 introduced by Council President Jones on behalf of Mayor Kennedy <br /> was given its third reading. A Resolution authorizing the Director of Public Service to <br /> advertise for bids for the award of a contract to provide construction services for the <br /> Bradley Road Pump Station Rehabilitation Project, as detailed in the specifications on <br /> file with the City Engineer, and authorizing the Mayor, following approval of the Board <br /> of Control, to contract for the same with the lowest and best bidder.
