1139.11 PLANNING AND ZONING CODE 98 <br />(b) No building permits shall be issued by the Building Official until such <br />development plan has been approved as provided herein. <br />(c) Failure to secure a building permit for all or an independent component of the <br />plan within one year after approval by the Commission shall void the plan as approved, unless <br />an extension of time is approved by Council. <br />(Ord. 90-125. Passed 5-21-91.) <br />1139.11 REGULATION OF SUPERSTORES. <br />(a) "Superstore" means a wholesale or retail discount store carrying a multiple <br />product line, which: <br />(1) Has 100,000 or more square feet of gross floor area, either <br />freestanding or as part of a shopping store development; or <br />(2) Is standing alone on a lot of ten or more acres. <br />(b) Superstores shall be constructed only upon lots meeting all of the following <br />requirements with respect to dimensions and location: <br />(1) Minimum lot size - ten acres; <br />(2) Minimum frontage - 300 feet; <br />(3) Frontage along at least one of the following main arterial streets: <br />Lorain Road, Brookpark Road, Great Northern Boulevard; <br />(4) Sixty percent (60%) of the lot area shall be located within one-half mile <br />of an interstate highway interchange consisting of minimally both an <br />eastbound and westbound entrance and exit ramp. (For the purpose of <br />measuring the one-half mile distance, the one-half mile arc shall begin <br />at the intersection of the centerline of the interstate highway and the <br />centerline of the public street onto which the highways ramps are <br />connected); and <br />(5) The lot shall have access to the interstate highway interchange from a <br />minimum four -lane road; <br />(c) Any developer proposing to construct a superstore in the City shall provide, at <br />its cost, a traffic control report prepared by a professional traffic engineer, detailing the <br />expected impact of the development upon traffic in the City, and shall present such report to <br />the City Engineer for his review and final approval as to the recommendations presented <br />therein; and the developer shall pay for the cost of any additional signalization or other <br />right-of-way improvements necessary, including the cost of land acquisition, to ameliorate the <br />impact of the proposed development to the fullest extent practicable. <br />(d) Any developer proposing to construct a superstore in the City shall further pay <br />the cost of any additional infrastructure improvements or adjustments required by the City <br />Engineer which, in the City Engineer's opinion, are necessary to protect the public health and <br />safety as a result of the proposed construction of the superstore, including but not limited to the <br />following: sanitary or storm sewer line connections and retention; street openings and <br />widenings; street lighting; and pedestrian walkways, together with the costs of any land <br />acquisition associated with any of the improvements. <br />(Ord. 93-140.
