Passed 12-3-91.) <br />(b) While performing the necessary work on private properties referred to in <br />subsection (a) hereof, the Service Director, Building Commissioner and City Engineer <br />or duly authorized employee of the City shall observe all safety rules applicable to the <br />premises established by the owner, and the owner shall be held harmless for injury or <br />death to the City employees and the City shall indemnify the owner against liability <br />claims and demands for personal injury or property damage asserted against the <br />company and growing out of the gauging and sampling operation, except as such may <br />be caused by negligence or failure of the company to maintain safe conditions as <br />required in Section 911.12 (g). <br />(c) The Service Director, Building Commissioner and City Engineer and other <br />duly authorized employees of the City bearing proper credentials and identification <br />shall be permitted to enter all private properties through which the City holds a duly <br />negotiated easement for the purpose of, but not limited to, inspection, observation, <br />measurement, sampling, repair and maintenance of any portion of the sewage works <br />lying within such easement. All entry and subsequent work, if any, on such easement <br />shall be done in full accordance with the terms of the duly negotiated easement <br />pertaining to the private property involved. Passed 4-26- 84.) <br />911.18 GRIEVANCES AND APPEALS. <br />Users connected to public sewers or to a private sewage disposal system will have <br />an opportunity to express complaints and grievances to the Service Director, who shall <br />investigate such complaints and grievances. Where a user requests an adjustment in an <br />extraordinary sewer bill caused by an accident or emergency at the user's property, the <br />Service Director shall conduct an investigation of the accident or emergency, and may <br />make an equitable adjustment to the user's sewer bill where the accident or emergency <br />caused the user to use an extraordinary amount of water and the extraordinary amount <br />of water did not directly enter into the City's public sewers. If the user is dissatisfied <br />with the decision of the Service Director, he or she may appeal the decision of the <br />Service Director to an appeals board consisting of the members of the Environmental <br />Committee of Council, and the Building Commissioner and Finance Director. The <br />Board, upon review of the record of the investigation conducted by the Service <br />Director, may affirm, reverse or modify any decision of the Service Director. (Ord. <br />2009-112.
