Meet with the Building Official or City representative and shall, with him or alone as instructed, visit <br />construction or other sites or buildings under jurisdictional authority of the City and make whatever <br />inspection reports, written or oral, that may be deemed necessary at the time. <br />Respond to requests to provide information or testify as requested by the Building Official or City <br />representative, or when subpoenaed by a court or other legal body of jurisdiction regarding any <br />matter for which the Architect has provided service or presented an opinion before the city. <br />Architect acknowledges that information or testimony required under this paragraph may, through no <br />fault of City, be required post termination of this agreement. Architect agrees that he shall provide <br />such information or testimony at a rate set forth in this agreement. <br />The Architect shall be reimbursed for travel, printing, mileage, long distance telephone calls, <br />reproduction, postage, and other typical reimbursable costs incurred during the performance of the <br />services. <br />GENERAL CONDITIONS <br />The Architect shall furnish such facilities and equipment he deems necessary to perform the services <br />under this agreement. The City shall provide the Architect one (1) copy of all plans and data submitted <br />for permit, review, or approval and shall further provide reference books, reports, and informational <br />material as requested by the Architect that may be required by the Architect. The City shall maintain <br />proper storage of all records and plans, and shall also maintain all records and plans required by the State <br />or OBC, including those required by the State to maintain Building Department certification. <br />The Architect shall be responsible to provide services for only the applications directed to him by the <br />City or City's representative, and have shall have no responsibility or liability for application's or <br />information not directed to him. <br />In consideration of the Architect's assistance to the City in the performance of a governmental function <br />for which the City is entitled to sovereign immunity, the City shall defend the Architect from any and all <br />claims arising from any of the services provided under this agreement. <br />The City agrees that the Architect shall have the right to engage in the practice of architecture for private <br />individuals within the City during the term of this agreement, provided that he shall not have interest in, <br />review, or approve any plans or work in which he has either drawn or participated in the drawing of, <br />which said plans he has to approve or recommend approval to the City or its Boards or Commissions. <br />Architect agrees to retain and secure all documents, drafts or other papers created in the performance of <br />his / her obligations under this agreement, all as otherwise required by R.C. § 149.43 et seq. <br />At the termination of the agreement, all documents, drafts or other papers in the possession of Architect <br />that are in any way related to performance of the services required herein shall be forthwith returned to <br />the City. <br />Architect acknowledges that all documents, drafts or other papers created in the performance of his / her <br />obligations under this agreement are the sole property of the City of North Olmsted. <br />2 <br />
