11 One, Two and Three-Familv Dwelling Code 1305.04 <br />1305.04 DEFINITIONS AND AMENDMENTS. <br />(a) DeSnitions. Wherever titles, words and phrases are used in portions of the <br />One and Two-Family Dwelling Code herein adopted, such terms shall be construed to <br />mean the equivalent offfcer, word or phrase applicable to the City. "Building; <br />Official" as used in such Code, means the Building Commissioner of the City. <br />(b) Amendments. The One and Two-Family Dwelling Code adopted herein is hereby <br />modified in the manner respectively indicated: <br />Sec. R-103-Scope (Amended). The provisions of this code apply to the construction, <br />alteration, repair, use, occupancy and maintenance of detached one, two and three- <br />family dwellings and their accessory structures. <br />Sec. ft-105-Entr_y (Amended). The Building Commissioner or any of his designated <br />agents may at any reasonable hour, enter any dwelling, multifamily dwelling, <br />building, structure or premises within the City to perform any duty imposed on him <br />by this building code, provided that permission to enter is obtained from the occupant <br />or, in the case of unoccupied property, from the owner or his agent. If such per- <br />mission is refused or is othervyise unobtainable, a search warrant must be obtained <br />before such entry or inspection is made, except in the case of an eidsting emergency <br />in which case entry may be made at any time and no search warrant is necessary. <br />No person shall refuse to permit such emergency entry or inspection, nor shall <br />any person hinder, obstruct, resist, or abuse any person making or attempting to <br />make such entry or inspection. <br />Sec. R-106-Violations and Penalties (Amended). No person, firm or corporation, <br />whether as owner, lessee, sub-lessee, or occupant shall erect, construct, enlarge, <br />alter, repair, improve, remove, convert, demolish, equip, use, occupy or maintain <br />any one, two or three-family dwelling in the City or cause or permit the same ta <br />be done, contrary to or in violation of any provision of xhis code. <br />Whoever violates any provision of this chapter or any code adopted herein or fails <br />to comply with any lawful order issued pursuant thereto is guilty of a misdemeanor <br />of the third degree. Each day during which noncompliance o r a violation continues <br />shall constitute a separate offense. The City may institute injuxkction proceedings <br />in Common Please Court to abate the nuisance of any violation or failure to cease <br />work after receipt of a stop work order. <br />Sec. R-107-Right of Appeal (Amended). All persons shall have the right to appeal <br />the Building Commissioner's decision to the Board of Building Appeals established <br />under Chapter 1315 of Part Thirteen Building Code. Sec. R-112-Prefabricated Construction (Amended). The Ohio Basic Building <br />Code provisions as published in Chapter 4101:2-18 of the Ohio Administrative <br />? Code shall apply to and govern one, two and three-family dwellings constructed <br />of industrialized units, notwithstanding any provisions to the contrary as contained <br />in the One and Two Family Dwelling Code adopted herein. <br />1982 Replacement
