Council Minutes of 3-5-2019 <br />approving it. Mr. Bruehler said the front of the building and the west side of the building <br />is a parking lot and there is no need for lights all the way back to almost the driveway of <br />the medical building. <br />Mayor Kennedy said if there are no need for lights, they wouldn't spend the money on <br />them. He said the reality is if you abut commercial property they have as much right as <br />you do to do what they want with their property. If a resident doesn't like it, buy it. He <br />said with all due respect when Emerald Village got built, his whole neighborhood was up <br />in arms that it was ruining the view, but at the end of the day you did not buy the view <br />and businesses are allowed to build their buildings and it went through the process and it <br />met the city Code. <br />Mr. Bruehler said he doesn't buy it as there is going to be no cement, no parking there. <br />The only parking is going to be at the top of the hill 100 feet from those lights so explain <br />what they are going to be protecting the grass from. <br />Mayor Kennedy said he would need to look at the project again to say. <br />Director Lieber said the lighting is adjacent to the parking lot that was being added. For <br />the number of employees and number of vehicles they are planning on servicing. We all <br />know while the operations might be limited to the day time, this is a climate where it <br />could be 4:30 p.m. and still dark outside so they are providing lighting for the vehicles <br />parked there and the employees. The Code does have a requirement lighting deemed <br />nonessential for safety has to be reduced by 50% after 11:00 p.m. or turned off in areas <br />where it is not used so they will have to comply with that portion of the Code. <br />Council President Jones told Mr. Bruehler that if he would like to address Council again <br />to please return to the podium and speak in front of the microphone as the recording <br />system can only record someone if they are in front of the microphone. <br />Mr. Bruehler asked if there are no cars there after 9:00 p.m. those lights will go off. <br />Director Lieber said, I did not say that. I said the Code says that lighting not essential for <br />safety has to be reduced by at least 50%. <br />Mr. Bruehler said if there is nobody there, what safety are we talking about. He said I'm <br />sure that shop is going to close at 6 p.m. <br />Director Lieber said it is to protect property. <br />Mr. Bruehler asked what property. If you look, cars will be parking within 50 feet of <br />Lorain Road and there are already lights there with Lazy Boy. <br />Councilman Brossard said that when Mr. Bruehler called him about concerns with <br />potential lighting at that property, he did call the Planning Director. He said there will be <br />devices that will block the northern facing lights on the pole. Mr. Brossard said to the <br />point about the courtesy of a phone call, he did in fact call Mr. Bruhler. <br />5 <br />
