Council Minutes ol'6-18-2019 <br />against it. He wants this Council to pass an ordinance outlawing the banning of plastic <br />bags. He said the County is no longer the strong entity it was before. He said it is now a <br />chartered organization, just like the city and thus they are on the same level as the City. <br />He said they have no right to tell North Olmsted businesses they cannot pass out plastic <br />bags if they want to because of home rule. <br />Council President Jones let Mr. Lambert know, he had one minute left. Mr. Lambert <br />asked for a five minute extension. <br />Councilman Kearnev moved to extend Mr. Lambert's time an additional live minutes. <br />The motion was seconded by Councilman Limpert and passed unanimously. <br />Roll Call: <br />Yes: Kearney, Limpert. Hemann, Glassburn, Brossard. Williamson. Schumann <br />No: None <br />Motion carried. Mr. L.ambcWs time extended five minutes by a vote of7-0. <br />Mr. Lambert said the County has overstepped its bounds and if push comes to shove the <br />City can tell its businesses it has the right to pass out plastic bags. Ile said, perhaps the <br />Ordinance could have a stipulation if a business uses plastic bags, it must have a <br />recycling bin for plastic bags to be returned to or perhaps the Ordinance can say only a <br />federal or state ban will be recognized. Mr. Lambert says if it goes to court, the municipal <br />court will hear the challenge, not the county court. Mr. Lambert suggested this idea be <br />heard in the Environmental Control committee. He said the City needs to take a bold <br />stand to defend its' right to home rule. He asked the Clerk of Council to inform him if <br />and when this committee meeting is scheduled so he can add sorne additional input. <br />LEGISLATION <br />Ordinance 2019-60 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance to make appropriations for current expenses and other expenditures for the <br />City of North Olmsted for the year ending December 31, 2019 and declaring an <br />emergency, as amended. Councilman Kearney moved for adoption. The motion was <br />seconded by Councilman Brossard and passed unanimously. <br />Roll Call: <br />Yes: Kearney, Brossard, Hemann, Williamson, Glassburn, Limpert, Schumann <br />No: None <br />Motion carried. Ordinance 2019-60 adopted 7-0. <br />Resolution 2019-61 introduced by Mayor Kennedy was given its third reading. A <br />Resolution adopting the alternative tax budget of the City of North Olmsted for the fiscal <br />year beginning January 1, 2020, and submitting the same to the Cuyahoga County Fiscal <br />Officer and its budget commission, and declaring an emergency. Councilman Schumann <br />moved for adoption. The motion was seconded by Councilman Brossard and passed <br />unanimously. <br />Roll Call: <br />4 <br />
