Council Minutes of 11-6-2019 <br />the Parks and Recreation writers could have written a better script. Mr. Limpert said this <br />is a very good situation here and hopes everyone realizes it. <br />Jim Burns <br />30119 Lorain Road <br />Mr. Burns said he was at the meeting on behalf of the Chamber of Commerce. He said <br />the Chamber is also opposed to Ordinances 2019-90 and 2019-91. He said in the Code <br />itself the Director of Planning and Director of Human Resources have specific education <br />requirements they have to meet to hold the positions. He said the Director of Human <br />Resources has no training for the Building Department and the Director of Planning & <br />Development has no training for the other services. He said there would be a problem <br />where Directors are not qualified by Code to handle the departments. Mr. Burns said the <br />Building Code and Zoning Codes would all have to be revamped as the Building <br />Commissioner would now be reporting to the wrong person. Mr. Burns also said there are <br />federal requirements that Human Resources has to deal with that Planning does not and <br />vice versa. He said by making this change the City will be exposing themselves to <br />liability down the road it really doesn't want to. He requested the Ordinances be put back <br />in committee or preferably tabled. <br />LEGISLATION <br />Ordinance 2019-80 introduced by Councilwoman Williamson was given its third reading. <br />An Ordinance amending Chapter 557 of the General Offenses Code of the City of North <br />Olmsted, entitled "Sale of Cigarettes and Tobacco Products to Minors," in order to <br />prohibit the sale to or possession of cigarettes, electronic cigarettes and vaping devices by <br />individuals under 21 years of age, and declaring an emergency, as amended. <br />Councilwoman Williamson moved for adoption. The motion was seconded by <br />Councilman Brossard and passed unanimously. <br />Roll Call: <br />Yes: Williamson, Brossard, Hemann, Kearney, Glassbum, Schumann, Limpert <br />No: None <br />Motion carried. Ordinance 2019-80 adopted 7-0. <br />Councilwoman Hemann voted yes with comment. I would like to thank Law Director <br />Gareau for working so hard at all of my tedious questions regarding this legislation. I had <br />concerns about the adult portion, the 18 and over portion, of this legislation and he did a <br />very good job at getting down to the bottom of all of them and making it possible for me <br />to vote yes. Thank you. <br />Resolution 2019-88 introduced by Mayor Kennedy was given its third reading. A <br />Resolution authorizing and directing the Director of Planning and Development to make <br />application on behalf of the City of North Olmsted for Community Development Block <br />Grant (CDBG) funds for the fiscal year 2020 for the North Olmsted Community Park <br />Walking Path project; further authorizing the Mayor to accept the grant if awarded and to <br />execute a contract with Cuyahoga County, and declaring an emergency.
