Council Minutes of 12-3-2019 No: None Motion carried. Resolution 2019-98 amended 7-0. • Discussed next was Resolution 2019-99. A Resolution authorizing the Mayor to enter into a one year contract with TAC Computer Inc. in order to provide maintenance and repair services to computer hardware and software in the North Olmsted Fire Department, and declaring an emergency. This is an annual contract with TAC. This is for the Fire Department portion. The annual amount is the same as last year. The committee voted 3-0 to recommend to Council. Councilwoman Williamson Chairwoman of the Building, Zoning & Development Committee: The Building, Zoning & Development Committee met on Tuesday, November 26, 2019 at 7:00 p.m. Present were committee members Williamson, Limpert and Schumann; Council members Brossard, Glassburn and Kearney; Council President Jones; Mayor Kennedy, Director of Law Gareau, Director of Safety & Service Glauner, Director of Planning & Development Lieber, applicant and guests. • Discussed was CMS 19-13004 Arby's, located at 26330 Lorain Road. The proposal for this project consists of a new drive through restaurant located in the former BuyBacks property. The existing retail building will be demolished and the site will be rebuilt for Arby's. The property includes regrading to eliminate changes in elevation between the current Arby's site and the new location. The property will have one entrance drive from Lorain Road and a right turn only lane exiting onto Lorain Road. An exit only drive will be provided onto Silverdale. The Silverdale curb cut was approved by City Council in 2014 through a legal procedure involving an amendment to the 1990 Declaration of Restrictions attached to the property. The amendment was conditioned upon the use and approved site plan. Since the use and site plan will be changing, it was recommended to Council the Declaration of Restrictions be eliminated at this time. Deliveries to the property will take place during non -business hours and the applicant has been advised of city business regulations regarding deliveries to commercial establishments adjacent to residential property. The committee voted 3-0 to recommend to Council with the conditions imposed by the Planning and Design Commission and including the elimination of the Declaration of Restrictions. Councilwoman Williamson moved to approve CMS 19-13004 Arby's, located at 26330 Lorain Road with the conditions imposed by the Planning and Design Commission and including the elimination of the Declaration of Restrictions. The motion was seconded by Councilman Limpert and passed 5-1. Roll Call: Yes: Williamson, Limpert, Brossard, Kearney, Schumann No: Glassburn Abstained: Hemann, due to not being at the meeting.
