Council Minutes of 12-3-2019 <br />No: None <br />Motion carried. Resolution 2019-98 amended 7-0. <br />• Discussed next was Resolution 2019-99. A Resolution authorizing the Mayor to <br />enter into a one year contract with TAC Computer Inc. in order to provide <br />maintenance and repair services to computer hardware and software in the North <br />Olmsted Fire Department, and declaring an emergency. This is an annual contract <br />with TAC. This is for the Fire Department portion. The annual amount is the same <br />as last year. The committee voted 3-0 to recommend to Council. <br />Councilwoman Williamson Chairwoman of the Building, Zoning & Development <br />Committee: <br />The Building, Zoning & Development Committee met on Tuesday, November 26, 2019 <br />at 7:00 p.m. Present were committee members Williamson, Limpert and Schumann; <br />Council members Brossard, Glassburn and Kearney; Council President Jones; Mayor <br />Kennedy, Director of Law Gareau, Director of Safety & Service Glauner, Director of <br />Planning & Development Lieber, applicant and guests. <br />• Discussed was CMS 19-13004 Arby's, located at 26330 Lorain Road. The <br />proposal for this project consists of a new drive through restaurant located in the <br />former BuyBacks property. The existing retail building will be demolished and <br />the site will be rebuilt for Arby's. The property includes regrading to eliminate <br />changes in elevation between the current Arby's site and the new location. The <br />property will have one entrance drive from Lorain Road and a right turn only lane <br />exiting onto Lorain Road. An exit only drive will be provided onto Silverdale. <br />The Silverdale curb cut was approved by City Council in 2014 through a legal <br />procedure involving an amendment to the 1990 Declaration of Restrictions <br />attached to the property. The amendment was conditioned upon the use and <br />approved site plan. Since the use and site plan will be changing, it was <br />recommended to Council the Declaration of Restrictions be eliminated at this <br />time. Deliveries to the property will take place during non -business hours and the <br />applicant has been advised of city business regulations regarding deliveries to <br />commercial establishments adjacent to residential property. The committee voted <br />3-0 to recommend to Council with the conditions imposed by the Planning and <br />Design Commission and including the elimination of the Declaration of <br />Restrictions. <br />Councilwoman Williamson moved to approve CMS 19-13004 Arby's, located at 26330 <br />Lorain Road with the conditions imposed by the Planning and Design Commission and <br />including the elimination of the Declaration of Restrictions. The motion was seconded by <br />Councilman Limpert and passed 5-1. <br />Roll Call: <br />Yes: Williamson, Limpert, Brossard, Kearney, Schumann <br />No: Glassburn <br />Abstained: Hemann, due to not being at the meeting. <br />Motion carried.
