Council Minutes of 12-3-2019 <br />evening news he saw that Lakewood made texting and driving a primary offense with a <br />fine of either $250 or $150. Mr. Mahoney wanted to know the current status of North <br />Olmsted's texting and driving law. <br />Director Gareau said that Mr. Schumann introduced an Ordinance several years ago to <br />make it a primary offense. He said he doesn't know if it has a mandatory minimum of <br />$2501anguage. <br />Chief Wagner said the law in North Olmsted makes it a primary offense to be using any <br />electronic communication device with your hands while driving. <br />Mr. Mahoney said he originated the no texting while driving ordinance many years ago, <br />but his other question was how many citations has the police department issued for <br />texting while driving in the past three calendar years. <br />Director Gareau said he should be able to get that information for Mr. Mahoney fairly <br />easily. He said he knows it's an increasing number each year. <br />Dennis Lambert <br />25057 Carey Lane <br />Mr. Lambert said he was here to address Ordinance 2019-105. He said noticed <br />Councilman Kearney's name on the Ordinance. He said he approached Council back in <br />June of this year recommending the City take a stand against the County Ordinance. Mr. <br />Lambert said it wasn't the bag ordinance, it was the County overstepping its authority. He <br />said not only are you opting the City out, but are requiring that stores that pass the bags <br />out recycle them. Mr. Lambert thought that was good. He said he now wants Council to <br />pass a Resolution declaring this City environmentally friendly and encourage the State <br />and Federal Government to put in a ban on all single use plastic items or packaging that <br />are not biodegradable. He said most people think he is opposed to restricting the bags. He <br />said he is not opposed, he said his issue is with the legislation and who was <br />overextending their authority. He said he is here to commend the Council, Law Director <br />and Administration. He wants this to pass fast and then to encourage the State and <br />Federal government to put a ban on all single use non -biodegradable products such as <br />cups, straws, etc. <br />LEGISLATION <br />Ordinance 2019-94 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance amending, reorganizing and re-establishing Section 131.99 of the <br />Administrative Code, entitled "Composition and Organization of the Office of Mayor" in <br />order to add the position of "Clubhouse Coordinator" to the Organizational Chart under <br />the Division of Springvale, and declaring an emergency. Councilman Schumann moved <br />for adoption. The motion was seconded by Councilman Brossard and passed 6-1. <br />Roll Call: <br />Yes: Schumann, Brossard, Hemann, Kearney, Limpert, Williamson <br />No: Glassburn <br />5 <br />
