Special Council Minutes of 12-16-2019 <br />and (2) creating new Chapter 761 of the Business Regulation Code of the <br />Codified Ordinances of the City of North Olmsted entitled "Retail Disposable <br />Bag Recycling," and declaring an emergency. A discussion was had regarding the <br />parameters of the legislation regarding the City of North Olmsted's ability to opt <br />out of the Cuyahoga County Council legislation banning the distribution and use <br />of plastic bags for businesses within the County effective January 1, 2020. The <br />legislation has the City opt out of the legislation while creating its own parameters <br />for the distribution and use of plastic bags by businesses within the City of North <br />Olmsted beginning in September of 2020. The discussion moved to seek an <br />amendment for 2019-105 for the purpose of defining the specification for the use <br />of recycling locations within the legislatively defined businesses. The amendment <br />describes the recycling containers and function will be done inside the business <br />and not outside in a parking lot for example. The Director of Law was asked to <br />prepare an amendment for the next Council meeting. The committee voted 2-1 to <br />recommend to Council. <br />Councilwoman Hemann moved to amend Ordinance 2019-105. The motion was <br />seconded by Councilman Glassburn and passed 6-1. <br />Roll Call: <br />Yes: Hemann, Brossard, Kearney, Limpert, Schumann, Williamson <br />No: Glassburn <br />Motion carried. Ordinance 2019-105 amended 6-1. <br />Councilwoman Hemann added this was also discussed in Caucus this evening to include <br />e-mails and telephone calls. There was 19 contacts, not all of which were residents. <br />COMMUNICATIONS <br />The Council Clerk said as Councilwoman Hemann had mentioned, Council has received <br />multiple e-mails regarding 2019-105. All of those e-mails have been forwarded to all of <br />Council. <br />AUDIENCE PARTICIPATION <br />No participation. <br />LEGISLATION <br />Ordinance 2019-103 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance to make and transfer appropriations for current expenses and other <br />expenditures for the City of North Olmsted for the year ending December 31, 2019 and <br />declaring an emergency, as amended. <br />Resolution 2019-104 introduced by Mayor Kennedy was given its second reading. A <br />Resolution authorizing the Mayor to enter into a vending services contract with Pepsico <br />Foodservice, and declaring an emergency. <br />
