Council Minutes of 8-4-2020
and came right back. Our motion to dismiss will be promptly filed and submitted.
The City anticipates this will also be dismissed.
• The City of North Olmsted did file a proof of claim in the Purdue Pharma
bankruptcy in the Southern District of New York. They are one of the opioid
defendants in the multistate litigation. They were one of the biggest players in the
opioid issue. We did file a proof of claim to ensure we are protected in bankruptcy
and if there are any proceeds to be distributed from the bankruptcy we are in line.
• The City has filed a complaint in the Court of Common Pleas to enjoin the
Westbury Apartments from continuing to violate certain sections of the Code. We
have been in some form of litigation since at least 2016 when the City filed
criminal charges. There are more rounds of criminal and property maintenance
charges. In the not too distant past a piece of the building fell to the ground and
fortunately no one was hurt, but it has been an ongoing situation for decades. It is
a health and safety concern and the City is going to continue to fight to get this
resolved one way or another.
Director of Finance Copfer:
• The annual audit was completed at the end of July. It was filed with the State and
also GFOA. It's a clean opinion. There is only one management letter comment
regarding disaster recovery. The City has had this comment before and is in the
process of rectifying it through the things we did last year and continue to do this
year. The work should be completed by the end of this year so it will no longer be
a comment on our report.
Councilman Schumann asked for a moment of personal privilege. I just want to thank the
Mayor and storm crew for all the work they have been doing in Bretton Ridge and Park
Ridge. The Mayor has been having a bunch of meetings, one-on-one meetings with
residents to explain what the plans are. The storm crew guys have been out like crazy, not
only cleaning out catch basins like they normally do, but jetting out lines. They have also
been doing a lot of work helping residents find cleanouts and identify if any of the lateral
connections are jammed. I know for a fact they have done a ton of these as I have been
handling a lot of the phone calls for them and they have just been on the ball. I just
wanted to thank them.
Councilwoman Hemann Chairwoman of the Environmental Control Committee:
The Environmental Control Committee met on Tuesday, August 4, 2020 at 7:01 p.m.
Present were committee members Hemann, Glassburn and Williamson; Council members
Brossard, Kelly, Limpert and Schumann; Council President Jones; Mayor Kennedy,
Director of Finance Copfer, Director of Human Resources Gallo, Director of Safety &
Service Glauner, Director of Planning & Development Lieber, City Engineer DiFranco
and guests.
• The purpose of this meeting was a presentation of storm water mitigation and to
discuss work on the MacKenzie culvert project. The Mayor outlined his meetings
with residents that were affected by the recent flooding. He said the storm crew is
being led by Greg Peters of the sanitary crew for several weeks in order to
provide his expertise in storm sewer cleaning and mapping. The Bretton Ridge
