Council Minutes of 10-06-2020 <br />Director of Law Gareau: <br />• House Bill 242 was approved by the Senate. It is now off to the Governor for a <br />signature. It concerns plastic bags and the ability to issue regulations. Director <br />Gareau explained it preempts local regulations for one year and he went on to list <br />all the types of items it halts regulation on for one year as it was more than just <br />plastic bags. <br />• Regarding the nationwide opioid litigation, the Sixth Circuit Court of Appeals <br />said a certified negotiating class would not be allowed. This sets back the idea of <br />a negotiated class settlement. However, a great number of Ohio communities, <br />including North Olmsted have agreed to work together to find consensus towards <br />a resolution. It will be a matter of many months, if not years, before there is a <br />resolution on this litigation. <br />Director of Finance Copfer: <br />• Today the City received a news alert from RITA. They notified members they are <br />working to develop a model which will assist members in projecting the potential <br />revenue impact of workers continuing to work from home on a permanent basis <br />after the State of Emergency has ended. These impacts include loss of revenue in <br />each community from reduced employer withholdings and some communities a <br />potential gain in revenue from employees working at home and paying the full tax <br />rate of their community. There will be a separate projection of each municipality <br />based on 2018 data. As you are aware, there is a court case in Columbus <br />regarding this issue so it would be nice to know what our potential impact would <br />be. <br />Council President Jones, Committee of the Whole: <br />The Committee of the Whole met twice, once on Tuesday, September 22, 2020 at 8:53 <br />p.m. and again today Tuesday, October 6, 2020 at 6:45 p.m. Present were all of Council. <br />• The topics discussed at both meetings were CARES Act Funding and Council <br />accessibility options, including purchasing the appropriate equipment for Council <br />to start streaming its meetings. <br />Councilwoman Williamson Chairwoman of the Building, Zoning & Development <br />Committee: <br />The Building, Zoning & Development Committee met on Tuesday, September 22, 2020 <br />at 7:02 p.m. Present were committee members Williamson, Limpert and Schumann; <br />Councilmembers Brossard, Glassburn, Hemann and Kelly; Council President Jones; <br />Mayor Kennedy, Director of Human Resources Gallo, Director of Law Gareau, Director <br />of Planning and Community Development Lieber and guests. <br />• Discussed was Ordinance 2020-106. An Ordinance amending and re-establishing <br />Chapter 167.99 of the Administrative Code, entitled "Composition and <br />Organization of the Department of Human Resources" in order to implement <br />organization changes within the department and to create the new position of <br />"Building Department Coordinator", and declaring an emergency.
