Council Minutes of 10-20-2020 <br />permit wasn't pulled to do the work until late 2018 and that permit is still open. <br />On multiple occasions this year the parties have gone to mediation, which has <br />failed. On July 17th, all proceedings have been stayed and the judge has refused to <br />find a probation violation even though it is four years out and the work is not <br />completed. On March 15th, a large section of the building collapsed and fell onto <br />the ground below, which is exactly why they were being prosecuted. There is <br />work being done on the site right now, however, that work has not been cleared. <br />Two more criminal cases have been filed this year regarding the condition of the <br />underground garage. It is in a deplorable condition. These charges have been <br />stayed as well. As a result, in June the City filed a civil injunction downtown. The <br />City has asked the Common Pleas court to enjoin the continuing violations as it <br />poses a continuing threat to public safety. It is set for a phone conference <br />tomorrow. The Building Department and Law Department have continued to <br />work on this to try and get compliance to ensure anyone in the building will be <br />safe. It concerns the outside wall, some of the balconies and the underground <br />garage. Director Gareau said he thinks the problems are more pervasive than <br />anybody realizes. The building needs to be safe. It has taken a long time, but the <br />City will continue to push to have it rectified. <br />Councilwoman Hemann asked what the status is of the elevators. She asked if they are <br />both working or if only one is working. <br />Director Gareau said he does not have any case pending regarding elevators. He said he <br />would check to see if there are any open files in Building. He said it is also a potential <br />Fire Code issue so he can check and see if there are any notations about elevators not <br />functioning. <br />Councilwoman Hemann said she believes there was a point for about two years where <br />only one elevator was in service due to some part they could never receive. <br />Director Gareau said it is an example of ongoing maintenance issues. If there was a <br />period of time the elevator wasn't working, look at the other issues going back over <br />decades, he is not surprised to hear it, He said he hopes it is not accurate. <br />Director of Finance Copfer: <br />• RITA collections through September are $1.3 million behind the prior year, which <br />is 10.8%. It is actually an improvement percentage wise from earlier in the year. <br />When the revenue was reduced in March it was reduced by $1.6 million so if <br />going by what was reduced the City is doing better, if that is any consolation. <br />• RITA and Levin College of Urban Affairs has done some analysis on the impact <br />of people who are working remotely from home and what impact it might have on <br />each municipality. Levin used 2017 and RITA used 2018 collection data. They <br />ran several scenarios. North Olmsted is fairly budget neutral in all of the <br />scenarios. Director Copfer attributes that to having the 100% credit in place and <br />also the city having more residents working outside the City than residents who <br />work in the City. <br />• Today was the filing deadline for the first Office of Budget and Management <br />CARES Act funding report and North Olmsted did comply with it. <br />2 <br />
