Council Minutes of 8-3-2021 <br />led me to believe there likely was a scheduling or notification problem. A warrant <br />for her arrest was issued, but it was recalled today. Her attorney filed a motion to <br />recall it and the court granted it. There is no warrant out for her arrest and no <br />additional date has been set in Rocky River. The Director of Law listed the <br />charges that have been filed in Rocky River. The City also filed a complaint in the <br />Court of Common Pleas. This complaint would give enforcement authority <br />outside the City of North Olmsted and throughout Cuyahoga County. <br />• An employee at the Relax Spa at the Brookpark Road Extension was arrested for <br />prostitution. The North Olmsted Department of Law, Police Department and the <br />Westshore Enforcement Bureau conducted an investigation and an employee was <br />arrested. It was a false representation of a licensed massage therapist performing <br />services there so Director Lieber working with the Department of Law revoked <br />the Zoning Certificate of Occupancy and as of today the establishment is closed <br />and it is the intent to keep it closed. <br />• An injunction was brought against a repeat offender for zoning code violations on <br />Edgepark Drive. The first offenses were for property maintenance, this one was <br />for running a business with wooden pallets, bicycles and lawnmowers. There <br />were dozens if not a hundred of them all over the place. There has been an order <br />by the court for the business to cease. <br />• As Council knows, Kelly Patrick brought a lawsuit against the City of North <br />Olmsted alleging the City had violated public record law. The case has been <br />closed as it has been decided there was no violation by the City. However, two <br />days before this case was decided, she filed an action in federal court suing <br />Director Gareau, Prosecutor Gordillo and Detective Chuck Fioritto on a host of <br />frivolous claims. One of which in 2009 when Director Gareau allegedly did <br />something, when in fact he wasn't the Director of Law until 2010. These claims <br />have been submitted to insurance defense counsel and will be vigorously <br />defended. The insurance defense counsel has been instructed to the extent <br />possible to seek recovery of any cost of litigation. <br />• The next case deals with an individual who feels there was a prosecution that <br />should have taken place 20 years ago and brought an action against the County <br />prosecutor's office to compel prosecution and also sued the City of North <br />Olmsted. This was brought last year as well. It was defended successfully and it <br />was thrown out, an appeal was taken to the Ohio Supreme Court, which was <br />denied. A motion was filed at the Ohio Supreme Court asking them to reconsider. <br />I do not believe they will and that should be the end of this case. <br />Director of Finance Copfer: <br />• The May and year to date summary and detailed financial reports were e-mailed <br />to the Administration and Council on July Stn <br />• The Comprehensive Annual Financial Report for December 31, 2020 was filed <br />with Auditor's office at the end of June and was released by the Auditor's office <br />on July 15t".
