CITY of NORTH OLMSTED <br />Mayor Nicole Dailey Jones <br />a , • Mex Upton, Director I Department of Econi and Community Development <br />Jarrell Succi Director I Department of Public Safety <br />A 5200 Dover Center Road I Nora, Olmsted Ohio 44070 <br />May 23, 2023 <br />Beatrice Taylor <br />North Olmsted City Council Clerk <br />City of North Olmsted <br />5200 Dover Center Road <br />North Olmsted, OH 44070 <br />RE: Public Hearing on Ordinances 2023-52, 2023-53, and 2023-54 amending certain sections of the <br />zoning code of the City of North Olmsted. <br />Clerk Taylor, <br />This joint memorandum is submitted on behalf of the Office of the Public Safety Director and the <br />Office of the Director of Economic and Community Development in favor of Ordinances 2023-52, <br />2023-53,2023-54. <br />Discussion of the Leeislative Context <br />Section 1113.02 of the North Olmsted Codified Ordinances provides the framework for the legislative <br />intent of proposed amendments discussed in the legislation before the public this evening: "The <br />purpose of the Zoning Code shall be to provide by the provisions hereinafter made for the orderly <br />development of the land within the City and to provide in that manner for the public peace, health, <br />safety, convenience, comfort, prosperity and general welfare of its residents and of the City.' <br />Further, Ohio Revised Code Section 713.07 states "whenever the planning commission of any <br />municipal corporation or any board or officer with city planning powers, whether such commission, <br />board, or officer is created by statute or municipal charter, certifies to the legislative authority of the <br />municipal corporation any plan for the districting or zoning thereof according to the uses of buildings <br />and other structures and of premises, such legislative authority, in the interest of the promotion of <br />the public health, safety, convenience, comfort, prosperity, or general welfare, may regulate and <br />restrict the location of buildings and other structures and of premises to be used for trade, industry, <br />residence, or other specified uses, and for such purposes may divide the municipal corporation into <br />districts of such number, shape, and area as are best suited to carry out the purposes of this section. <br />t httLts://codelibrarv.amleaal.com/codes/northolmsted/latest/northolmsted oh/0-0-0- <br />19233#JD 1113 <br />
