CITY at NORTH OLMSTED <br />Mayor Nicole Dailey Jones <br />The B-3 district which purports to cater to the "motoring public' and is bound to the East by <br />Columbia Road and the West by Stearns Road and includes the Great Northern Mall property. The B-4 <br />Mixed Use encompasses the Brookpark Extension retail district and is intended to be in the "core of <br />the City". After thorough review of the business district's stated purpose, their location on the <br />current zoning map, setback and buffering requirements, it was determined that the service of <br />unregulated psychoactive substances for consumption on site was most appropriate, as a conditional <br />use, in the B-1 and B-2 zoning districts. Both the B-1 and B-2 are characterized by pedestrian <br />accessibility as well as mixed of residential and business uses. The relative proximity of <br />neighborhoods, the required buffering and setbacks required ensure that there is balance between <br />uses and districts alike. Subject to specific requirements as contemplated in Ordinance 2023-52. <br />Discussion of Specific Conditions as specified in Ordinance 2023-52 <br />Section 1118.01 provides additional latitude to the City to place further scrutiny to uses that may <br />more intensely affect the surrounding area in which they are located than permitted uses in the same <br />zoning district.' When examining the specific conditions 1118.08, in addition to the general <br />conditions as specified 1118.06 (A)(B) it was paramount the greatest extent and care be placed on <br />restricting the proliferation of such uses. Therefore, the restrictions, as proposed, are modeled after <br />Ordinance 2023-18 recently authorized by North Olmsted City Council. Which placed the following <br />restrictions on Tattoo, Body Branding, Hookah Lounges, Drug Paraphernalia, Smoke Shops or Similar: <br />1. The use shall be located at least 3,000 feet, measured lot line to lot line, from the nearest <br />tattoo, branding, hookah lounge, drug paraphernalia, smoking establishments; <br />2. The use shall be located within a commercial shopping center building with the combined <br />Floor area of all businesses being 30,000 square feet or more; <br />3.
