Council Minutes of 06-20-2023 <br />department, discussed the possibility of expanding the zoning from only B-3 and B-4 to add B-1 <br />and B-02, which had been discussed in Planning Commission and with the Law Director. This <br />approach was recommended by the Planning Commission per Councilwoman Hemann's <br />comments of the Commission's recommendations. Mr. O'Malley reaffirmed that being a zoning <br />ordinance, Council has the authority to restrict uses, and Mr. Limpert noted that Director <br />Gareau confirmed this was within the parameter of Council's zoning authority. Ordinance 2023- <br />52, an Ordinance Amending Section 1118.13 of the Planning and Zoning Code of the Codified <br />Ordinances of the City of North Olmsted entitled, "Offices and Services", in order to establish <br />Subsection (F) to limit the location of specified uses was favorably recommended 3-0. Ordinance <br />2023-53 an Ordinance establishing the definition of "Unregulated Psychoactive Substances" in <br />Section 1115.12 of the Planning and Zoning Code of the Codified Ordinances of the City of North <br />Olmsted entitled, "Definitions U -V;', for the purpose of adding definitions for uses associated <br />with the sale and consumption of same on business premises was favorably recommended 3-0, <br />and Ordinance 2023-54 an Ordinance Amending Section 1139.03 of the North Olmsted Zoning <br />Code Entitled "Schedule of Uses" to conditional permit sale and consumption of unregulated <br />psychoactive substances on premises in B-1 and B-2 Zoning Districts was favorably <br />recommended 3-0 and the Committee Meeting concluded at 7:16 p.m. <br />Councilman Limpert moved to Amend 2023-52 to incorporate the language adopted by the passage of <br />Ordinance 2023-18. Resolution 2023-52 amended by a vote of 7-0. <br />Councilwoman Hemann, Chairwoman of the Recreation, Public Parks and Buildings Committee: <br />The Recreation, Public Parks and Buildings Committee met on Tuesday, lune 13, 2023 at 7:17 p.m. <br />Present were Committee Members Hemann, Scarl and Limpert and Council Members Williamson, <br />Glassburn, Madden and Gilchrist, Council President Brossard, Mayor Jones, Assistant Law Director <br />O'Malley, Assistant Finance Director Sperling, Economic and Community Development Upton, Safety <br />Director Scofield, Service Director Kearney, Special Assistant to the Mayor Massarolo and guests. <br />• Discussed Resolution 2023-71 a Resolution authorizing the Mayor to enter into a contract with <br />Holland Paving & Sealcoating to provide services to the Wastewater Treatment Plant at a cost of <br />$5,500.00. Ms. Hemann reported that Director Pinchek advised that the bid is from Holland <br />Paving and Sealcoating, to repave approximately 80,400 sq. ft., and that this is a project that <br />takes place every few years and the cost is within the standard scope. The legislation was <br />favorably recommended 3-0, and the Committee Meeting concluded at 7:19 p.m. <br />Councilman Glassburn, Chairman of the Finance Committee: <br />The Finance Committee met on Tuesday, June 13, 2023 at 7:20 p.m. Present were Committee Members <br />Glassburn, Williamson and Limpert and Council Members Hemann, Madden, Gilchrist and Scarl, Council <br />President Brossard, Mayor Jones, Assistant Law Director O'Malley, Assistant Finance Director Sperling, <br />Economic and Community Development Upton, Safety Director Scofield, Service Director Kearney, <br />Special Assistant to the Mayor Massarolo and guests. <br />• Discussed Ordinance 2023-69 an Ordinance Amending Section 902.03 entitled "Annual <br />Registration Required" of Chapter 902 of the Streets, Utilities and Public Services Code of the <br />City of North Olmsted, entitled "Use of Public Right -of -Way by Service Providers and Contractors <br />Performing Work of Service Provider Facilities", in order to provide for annual registration fees. <br />Both 2023-69 and 2023-70 were discussed together as they were similar pieces of legislation <br />
