has accumulated sick leave time, the retiring employee may convert one-half (1/2) of the <br />accumulated sick leave time (with the City of North Olmsted) to pay on the basis of his <br />rate of pay at the time of retirement but the maximum amount paid shall not exceed one <br />thousand (1,000) hours. <br />15.03. Abuse of Sick Leave/Patterned Absence. Consistent with the just cause standard in <br />Article 30, the Employer may discipline or, if appropriate, discharge an employee for abuse of <br />sick leave or the patterned use of sick leave (Ex. repeated Mondays, Fridays, or days after <br />payday) <br />15.04. Sick Leave Pay Limitations. Sick leave shall not be paid to any full-time employees <br />which exceeds forty (40) hours in a normal work week as defined in Article 10, Sections I and 2, <br />of this Agreement. <br />15.05. Sick Leave Transfer/Order of Use. Employees hired after July 1,1998 and have <br />accumulated sick leave with another political subdivision will be allowed transfer said sick leave <br />Gity -`�-" Olmste-ri but such sick leave cary-over from another political subdivision shall <br />not be used to calculate an employee's buy-out pursuant to Section I (e) above. <br />15.06. Designation of FML Oualihing Sick Leave. If an employee is absent on sick leave or <br />other related reasons for more than three (3) consecutive work days and said absence qualifies <br />under the FMLA, the Employer may apply those days against the twelve (11) week leave <br />period <br />15.07. Fitness for Duty Examinations/Disability Separation. The procedure and appeals for <br />fitness for duty examinations and disability separations will be handled in accordance with <br />Citypolicy and the applicable civil service disability separation and appeals process. <br />ARTICLE 16 G4i#SR,4h UNPAID DISABITTYIPERSONAL LEAVE REQUESTS <br />SANS <br />16.01. Unpaid Disability Leave Reauesa. All unpaid disability leaves of absence when known <br />in advance (and any extensions thereof) must be applied for and granted in writing on forms <br />provided by the Employer (copy to the employee). The employer will notify Ari the employee <br />and the Union wv8- IRP -aeft€tewithin five (5) working days from the date the application was <br />made of approval or denial of the request leave. <br />16.02. Seniority and Benefit Continuation during Unpaid Disability Leave. An employee <br />shall accumulate seniority during any unpaid leave of absence, but he shall not be entitled to any <br />benefits, except that the Employer shall continue to pay its portion of the employee's <br />hospitalization insurance during an unpaid FML period in A-"-'- ^_` `-- - three "` men <br />period. After the three-(?) mooth FML period, an employee must direct pay any required <br />hospital/surgical premiums to the Employer on or before the monthly due date and comply with <br />the other applicable requirements for making a COBRA election. <br />14 <br />4880-6940-6880, v.2 <br />
